Ah, matrimony! That blissful union of souls destined to tango through life, hand in hand, sharing samosas and sorrows alike. Or is it? Lately, our beloved marriage mart has turned into a Bollywood flick with more twists and turns than a jalebi – except here, the villain isn’t some moustache-twirling goon, but a set of laws so lopsided, they’d make even Newton question gravity.
I’m talking about the matrimonial laws, folks, those supposed guardians of marital bliss that have, in some cases, become instruments of… well, let’s just say “creative interpretation.”
Picture this: You wake up to a thunderous banging on your door, not the postman bearing good tidings, but khaki-clad figures brandishing a warrant for your arrest. Your crime? You are a husband. Not just any husband, mind you, but one accused of the cardinal sin in the Indian matrimonial battlefield – cruelty to your wife. The weapon? Not a fist, not a harsh word, but a law – a weapon so sharp and one-sided, it could sever your life in two.
Biased Matriomonial Laws in India
Welcome to the twisted tango of biased matrimonial laws in India, where the presumption of innocence wears a burqa, and men are pre-convicted in the court of public opinion. Where Section 498-A IPC (one of the most misused laws in the country), that was originally intended to be a shield against genuine cruelty, has morphed into a sword, wielded by some, not to seek justice, but to settle scores, extract vengeance, or worse – extort.
And it’s not just me, even the Supreme Court of India has termed this misuse as legal terrorism. A wife can file a case against the husband and his entire extended family, (including the family dog – who might have barked at her once) in any court across the country, turning the husband and his family into legal nomads, dashing from pillar to post, their lives put on hold while hers continues unabated.
Guilty Before Verdict
The horror stories are legion. Men falsely accused of dowry harassment, are paraded before society as wife-beaters, their careers and reputations go into tatters, even before a trial begins. It shatters families like porcelain dropped from a skyscraper. And for what? Often, it boils down to a bitter alimony battle, a weaponized maintenance demand, or simply, the intoxicating power of wielding a law that presumes guilt, not innocence.
But wait, there’s more! The Domestic Violence Act (DV) joins the party, adding a spicy salsa of emotional abuse to the matrimonial mayhem. A raised eyebrow? A sarcastic comment? Bingo! You’re officially a monster, banished to the doghouse of societal scorn. And let’s not forget the cherry on top – the Maintenance Act. Remember that time you promised your wife the moon? Well, the court might just award her a slice of it, along with a hefty chunk of your bank account. Suddenly, your happily-ever-after feels more like a happily-ever-aftermath of financial ruin.
And the cost of “clearing your name”? Often, it’s the man’s life savings, his dreams, his very sanity. Under the pressure of a long, drawn-out legal battle, many men cave in and agree to settlements that would make Scrooge McDuck weep!!
Cry For Justice Vs False Alarm
Yes, abuse exists. There are genuine cases of domestic abuse, cases that cry out for justice. And those men, those monsters who inflict physical and emotional pain on their wives, deserve the full weight of the law to come crashing down upon them. But let us not mistake the weeds for the garden, let us not paint all men with the same brush dipped in vitriol. Women face real, horrific violence at the hands of some men. But the problem isn’t the existence of laws to protect them, it’s the gross misuse and weaponisation of those very laws. Laws become tools for extortion, for revenge, for settling petty scores.
What About Us Men?
But here’s the real kicker: What about the men who are being abused? The ones who get beaten black and blue by their wives, threatened by their in-laws, and silenced by the fear of social shame? Their stories, sadly, rarely make the headlines. They become the invisible men, swallowed completely by a system that often seems to presume their guilt.
And guess what, there are no laws in the country to protect a man from marital abuse and domestic violence. There are numerous instances where men have left behind suicide notes, narrating how these matrimonial laws were misused to make their lives a living hell. Some have left behind videos, drenched in tears, pleading the courts, the lawmakers and society at large to stop the misuse of the laws that have taken shape of legal terrorism. And does the gavel come down to smash a fake claim into smithereens? Well, the severest punishment is a simple slap on the wrist, which in my opinion is an encouragement for the perpetrators to go looking for their next victim.
Stop Turning Innocent Men Into Criminals
Think of it like this: When a man is falsely accused, his life becomes a living hell. His reputation is tarnished, his career hangs by a thread, and the emotional toll is immeasurable. This can turn a good man bitter, even push him towards the very darkness he’s accused of. Are we not, then, creating potential criminals out of wronged men?
Let’s be clear: Protecting women from violence is not, and should never be at odds with protecting men from false accusations and malicious misuse of the law. We need gender-neutral laws, laws that treat every human being with equal respect and presumption of innocence until proven guilty. Laws must punish the guilty, regardless of their gender, and offer redressal to the wronged, irrespective of their chromosomes.

What Is Marriage?
Imagine a society where justice is blind, where laws are weapons wielded with fairness, not vengeance. Where marriage is not a minefield, but a haven, where both partners walk hand-in-hand, knowing that the law protects them equally, not pits them against each other in a gladiatorial arena of accusation and counter-accusation.
This is not a utopian dream, it is a necessity. For if we continue down this path, if we fail to address the imbalance, the day might come when men, weary of being seen as potential criminals, turn away from marriage altogether. Is this the legacy we want to leave for our children, a society fractured by distrust, poisoned by prejudice?
Time To Act, Time To Voice Your Opinion, Time To Demand Reform
Now, it is the time to act. Time to raise our voices, demand reform, and create a legal system that protects all human beings from violence and abuse, regardless of their gender. Let us strive for a future where marriage is a celebration, not a battlefield, where love finds refuge, not ruin, in the arms of the law.
We need to raise our daughters to be strong, independent women, not vengeful warriors armed with legal weapons. We need to teach them that true empowerment comes not from crushing others, but from building themselves up. And we need to raise our sons to be respectful, compassionate partners, men who understand that love is not about dominance, but about cherishing the other person, being empathetic towards their wives who’re entering a new mysterious world when entering their matrimonial homes. Let’s rely on trust, instead of prenups to create happy marriages.
Remember, we are not just husbands and wives, we are human beings first. And human beings deserve justice, not a legal labyrinth where one’s gender dictates other’s fate. Let us break free from the chains of bias, together, and build a society where love, not fear, forms the bedrock of every marriage.
