How many of you know what is Section 498-A IPC? If you have been following Voice For Men India regularly or have got trapped into this, then you would be surely aware. But there is a majority segment in India that still has no clue whatsoever about the draconian matrimonial laws in India.
These laws are not just limited to you as a husband, but to every single relative of your family, even if they happened to just meet your bride at the marriage reception!
Today, we bring to you a story of one such harassment case shared by a man who has been charged under Section 498-A IPC by his cousin’s wife…..Yes you read that right!!
His Story
Piyush (name changed) is an NRI and has his family, including parents, living in India. Piyush has been charged under multiple criminal sections because he was guiding his cousin to exit his bad marriage.
Case in Brief:
Piyush’s 12th pass jobless cousin Ajay (18-years) (name changed) fell in love with Pinky (25-years) (name changed), whom he met at the gym. The two were good friends for the first three years and then Pinky started pressurizing Ajay to marry her.
Pinky was giving threats of suicide, mentally and emotionally forcing Ajay to marry her secretly at the court. She also suggested that after marriage, they would not share this update with anyone until next 6-months, incase they change their mind about each other and want to mutually separate. However, after 6-months, Pinky adopted the same threatening tactics on Ajay forcing him to introduce her to his family.
All this time, Pinky’s family was very much aware of the wedding, while Ajay’s parents had no clue.
On one occasion, Ajay did not return home and a week later, his parents received his marriage certificate via post. The same was couriered to Ajay’s family by Pinky’s brother.
This is the time when Ajay opened up to his family that he was compelled to marry Pinky using multiple threats. Later, Ajay infact left his own home and started living at Pinky’s parental residence.
Piyush’s Crime & Involvement
You must be wondering how did Piyush get involved in this matter? Well, Piyush had decided to counsel his cousin and guide him to exit such marriage, basis of which was threat and pressure. Subsequently, Ajay found the courage and filed for divorce.
As a result of this, Piyush was slapped with three cases against him by Pinky & her family:
- Kidnapping his cousin from bride’s house
- Harassing the newlywed bride
- Asking for Dowry (Section 498A IPC)
Piyush shares:
My cousin is still taking mental therapy sessions with a psychiatrist. All this fear-mongering, threats, false cases, drama for what?
I don’t know about the girl and her family. Because I found all of them dangerously stupid. And I am yet to figure out why they destroyed their own daughter’s life.
My not-so-trustworthy sources claim Pinky’s family has a history of such cases and they do it for money.
With regards to his experience with Indian police officials in the matter, Piyush claimed that he was asked for a bribe of Rs 5 lakh by one of the officers anticipating cases against him. He said:
The majority of Indian police use fear as a weapon to threaten ignorant innocent citizens and top up their monthly salaries in such cases.
All that Singham stuff is limited to Bollywood movies for entertainment only. The ground reality is brutal where protectors are the real predators. All of this could have been prevented if police was honest and working with integrity.
After this experience, I don’t miss India much. I am relatively happy and safe abroad.
Piyush also adds that he did not give into the fear mongering by the official, did not pay a penny and left for his country of residence. However, he shares that in his absence, the police was now troubling his old parents. Piyush states:
An FIR was registered against me after I left India. My parents were being called to the police station from my hometown which is 300 kms from the city where the case had been filed.
Piyush also goes on to say:
The officer even threatened my parents saying call your son back to India otherwise we will declare him wanted in the dowry case.
Piyush concludes his story that after this experience, he does not intend to return to India for the next decade.
Speaking to Voice For Men India after yet another adjournment in the matter, Piyush said,
The matter has been adjourned in the court again, it’s been over 6 months and the FIR has not been quashed yet. In total, I have paid over Rs 2 lakh to the lawyers.
I have changed two lawyers and have now engaged a third one, since there is a huge deficit of trust with this fraternity. They all give assurance during consultation but once the money has been transferred they speak a complex language and never give a straight answer.
I am adding this to highlight the role of lawyers in such cases. In my experience, the real culprits are the police and lawyers more than the one who lodges a false case.
