In December 2022, a case was registered in Mumbai against three persons for allegedly gang raping a 42-year-old woman at knife-point and burning her private parts with cigarette butts.
Now, according to the investigation, police has found the allegations to be fake. One of the accused men had been in jail for 40-days for a crime he did not commit.
Case:
In her FIR, the complainant woman had alleged that on November 30 at around 5 am when she was sleeping in her house, someone knocked on the door. When she opened the door no one was outside, but the moment she turned to close it, three people barged into the house, reported Hindustan Times.
Adding to her statement, the alleged victim then accused one of the men of carrying a knife and pushing her on the floor. FIR read:
He slashed me on the chest, hand and inflicted burn injuries on my private parts with cigarettes. The trio then sexually assaulted me and threatened to kill me.
The woman had approached the Kurla police station where her statement was recorded. She was then admitted to Bhabha Hospital for two days.
FIR Registered Based On Woman’s Statement
Based on her statement, deputy commissioner of police, Manoj Patil, informed HT that an FIR was registered under:
- Section 376 (rape)
- Section 376 (d) (gang rape)
- Section 377 (unnatural offences)
- Section 452 (house-trespass after preparation for hurt, assault or wrongful restraint)
- Section 354 (assault or criminal force to woman with intent to outrage her modesty)
- Section 509 (Word, gesture or act intended to insult the modesty of a woman)
- Section 324 (voluntarily causing hurt by dangerous weapons)
- Section 323 (voluntarily causing hurt)
- Section 504 (intentional insult)
- Section 34 (common intent)
…of the IPC.
The police started their investigation and released a statement in December which was as below:
We have contacted the doctor to get a medical report regarding her allegations about the injuries on her body.

Police Investigation: Gang Rape Case Fake
After investigating the matter in detail, the Mumbai police has found the allegations of gang rape to be fake.
Two medical records were obtained from JJ and Bhabha Hospitals, which clearly stated that the rape allegation was false and the injuries were self-inflicted.

The police had also sent the visual evidence collected from the purported crime scene; the result came in early last week. According to sources at the Kurla police station, the forensic reports, too, could not back the allegations. Speaking with The Free Press Journal, a police official said,
We are in the process of making a summary report, which will be submitted in court. In this report, all the examination and forensic reports will be attached.

The police added the two other suspects had denied all allegations and stated that all of them were ‘made up’ by the victim to take revenge. The police said the rivalry stemmed from a joint drugs business.
The police had arrested one of the three suspects, Bablu aka Mohammad Yakub Siddiqui, who spent 40-days in jail until pending investigation.
