The absence of any strict laws or action against a false accuser woman has resulted in the number of false rape cases daily. It is not just shameful, but a complete mockery of our justice system.
In a recent incident reported from Kochi, Kerala, a woman falsely accused an unknown man of raping her, since she did not want her boyfriend to ‘leave her.’
Case:
A 19-year-old woman, who happens to be a migrant, was in a live-in arrangement with her boyfriend since the past one month. When her partner started showing signs of disinterest in her, she lodged a false complaint of rape against a 58-year-old autorickshaw driver, only to save her relationship.
Following her complaint, the Njarakkal police registered a case, however, they dropped it after learning that the girl had fabricated the incident and filed a fake rape case.
Police Statement
In a detailed statement to The New Indian Express, the SHO from Njarakkal police said:
The girl lodged a complaint on December 21. She claimed that she had taken an autorickshaw from Kadavanthra to Vypeen beach, but fainted due to low blood pressure during the journey.
She alleged that when she regained consciousness, she realised she was half-naked, and the autorickshaw driver was talking on the phone. She said she fled.
When the accused auto driver was traced, he was taken into custody immediately. The officer added,
Though we believed the autorickshaw driver did rape her, we later realised that it was a cooked-up story. The medical examination also ruled out sexual assault on the woman.
We also collected statements from a few people who said the autorickshaw driver dropped the woman near the beach, and that she walked to the beach around 5.30 pm on December 21.
Motive Behind Fake Rape Case
According to the police, the woman lodged the false rape complaint assuming that her boyfriend would not leave her and sort things out for her, if she faced any problem. The officer also told TNIE,
The marriage of her boyfriend’s brother will be held in Kottayam next week. So, the boyfriend would have to leave Kochi. She was not ready to accept this as she was not staying with her family and because he was the only person in touch with her.
She believed that lodging such a complaint would keep him busy, and she would be able to continue to stay with him.
Action Against False Accuser Woman
Police sources were still deliberating (as on Dec 25) whether a case needs to be registered against the woman for filing a fake rape complaint. The officer concluded:
She misused the law and put a person in trouble. So far, we haven’t registered a case against her. We will take action based on the directive from our superiors.

- But you will rarely see the celebrated women rights activists even acknowledging the menace of fake rape cases
- Such incidents are a slap to our system that believes woman’s word as final
- If men are lucky, the police will investigate in time and conclude the cases to be false (if so)
- If men are not so lucky, do not have the financial appetite to hire a competent lawyer, they end up as under trials for years/decades in our Indian jails
