An accused man from Nainital has been granted bail in a rape case, after the alleged victim confirmed that she was not raped.
The accused spent 20-months in jail.
Case:
An 18-year-old man was sent to jail in December 2021 after a 15-year-old girl accused him of rape.
An FIR was registered in the matter under IPC sections 323 (voluntarily causing hurt), 376(2)(n) (physical relations on promise to marry), 506 (criminal intimidation) and the POCSO Act at Banbhoolpura police station in Nainital.
Submission by Lawyer of Accused
The accused man’s counsel submitted that his client had been falsely implicated as his family had rejected the girl’s marriage proposal.
Statement by Minor
The girl, in her statement under Section 164 CrPC before the trial court, accepted that on the day of the alleged incident, she had called the youth to her house and he had not raped her.
Uttarakhand High Court
A single bench of Justice Manoj Tiwari of the Uttarakhand high court went through the details on record and granted bail to the man without commenting on the merits of the case.
Voice For Men India: This is only the bail stage. The ordeal for the man to get himself acquitted continues. He is only 18-years of age. He will live with the tag of a rapist and most probably lose out on best career opportunities in life.
