Many people abuse us when we speak about false rape cases in India. For society, it is almost unbelievable how any woman can file a false rape case. However, this is very much a darker side of reality.
In yet another case reported in July this year from Gujarat, a man has been acquitted from false rape case after spending two years in jail. The man had been falsely accused by his own daughter of raping her.
Case:
Balram Vishwambhar Jay, resident of Uttar Pradesh, started working as a Hindi-Sanskrit professor in Pardi, Valsad district of Gujarat in 2003.
On July 08, 2020, his minor daughter called up Child Helpline Number 1098 and informed them that she had been sexually assaulted by her father. Based on her complaint, local NGOs got an FIR registered against Balram at the Pardi police station. The father was arrested, while the daughter was sent to a child care centre.
After spending two years in jail, Balram was found to be innocent and acquitted by court in July 2022. After returning home, the innocent father had several questions for the system, which arrested him on mere complaint of his daughter.
Statement by Father
Speaking with ETV Bharat, Balram poured out his heart and narrated his ordeal that he faced for past two years. He expressed,
We were having dinner that night, when police came to arrest me. I was beaten up by police, presented in the court, and then sent to Navsari jail.
Balram added when his family approached child care centre to bring back the daughter, they refused to hand her back citing safety concerns. In the interim, the child care centre took care of the daughter and also continued her education through online classes.
High Court Acquits Father After 5-Years In False Rape Case Filed By Daughter
Balram, after his acquittal questioned, how NGOs can destroy a family by sending someone to jail like this. He asked who will return his loss dignity and the shame he faced in society and amongst relatives. Through his media statement, he urged all to share his case to spread awareness of what had happened to him. He said,
My life is ruined, but people must not dare to call 1098 like this randomly. My wife, other daughter and son too suffered as I was the only earning member. Not just me, my college’s reputation has also been tarnished.
My relatives were called up constantly and informed that I had already been convicted as rapist. They were informed that I was raping my daughter since two years, whereas, there was no such mention in the chargesheet.
My daughter was not even presented in front of me at the court. No one came to court to give any evidence. In this way, you are forcing people to turn into criminals.

He concluded,
I don’t want acquittal, I demand justice.
