How many false rape cases get filed in India – a question often asked! However, every single false rape case is a big blot on womanhood, and a curse to genuine victims of such crimes.
In a shocking report from Rajasthan, a woman got her husband booked on false charges of raping their 12-year-old daughter. The man has been acquitted after spending nearly 20-months in jail.
Case:
On December 26, 2020, a woman from Maroth village in Rajasthan filed a case under POCSO against her own husband, accusing him of raping their 12-year-old daughter.
As per a Dainik Bhaskar report, the mother also allegedly threatened to kill the daughter if she did not remain silent.
Subsequently, the police arrested the woman’s husband by registering a case under the POCSO Act. The police also conducted primary investigation, got his medical done and produced him at the court. The husband was sentenced to jail on December 27, 2020.

Trial
The trial in the matter started where statements of the victim and her mother were recorded. However, it was noted that the mother kept narrating a different incident each time. Several dates passed at the court where the trial was ongoing.
DNA, Other Evidences, Acquittal
The police subsequently presented material collected from the spot, DNA samples and other evidences in the court.
On May 5, 2022, the DNA and medical report was presented in the court, which confirmed that the minor daughter was not raped.
The man remained in jail for nearly 20-months during the ongoing trial, and was subsequently acquitted on September 1, 2022. He walked free on September 02, 2022.

Wife Confesses To Filing False Rape Case
During the cross questioning in the court, the wife confessed to filing the false rape case against her husband.
The reason given by the wife for doing so, was that she wanted to get her husband’s property in her name, but he was not agreeing. It is then, that the wife conspired with her brother and used her 12-year-old daughter as a pawn. The brother-sister duo then got the husband falsely arrested on charges of raping his minor daughter.

Minor Daughter’s Statement
In her earlier statement to the police, the young girl accused her father of rape, however, she changed her statement in the court blaming her mother and maternal uncle (mama) who tutored her in making those false allegations against the father.
She then made a statement in the court that her father was innocent and had not done anything wrong to her.

Special POCSO Court
After hearing the arguments and statements of both the parties, Special POCSO Court Judge Ratanlal Moond acquitted the innocent father. Judge Moond remarked,
What kind of a mother are you? A mother can never think bad for her daughter, son and family, but you have committed a heinous act like stigmatising a sacred relationship between the father and daughter.
Subsequently, the amount received by the daughter (alleged victim) under the Victim Compensation Scheme was also withdrawn.
In the entire case, the accused father did not even have sufficient money to hire a lawyer who could represent him. He was provided aide by the District Legal Services Authority and was represented by Advocate Kailash Narayan Dadhich, who did an excellent job to unearth the truth.

- Recently Rajasthan topped the NCRB list when it comes to Crimes Against Women
- CM Ashok Gehlot came out in strong defence, suggesting that 56% rape cases filed in the state in 2021 were false (read article above)
- There was a huge outrage from feminists attacking the CM for his statement
- While cases of rape need to be taken very seriously, there needs to be a very very strong punishment where women are making a mockery of the law for personal revenge, like in the case above
- Once again, the wife/mother is let scot free with oral remarks from the Judge – this is nothing but boosting confidence of such women that even if they repeat these offences in the future, they will be let free after destroying a man’s life
- None of the governments are willing to take any stern action against such women, and have provided ample shield in the name of ‘weaker sex’ – a term that suits all feminists when women are caught committing crimes
