Section 498-A IPC – Cruelty & Dowry Harassment to Wife by Husband and his family – is one of the most abused and misused laws today, which was introduced in the year 1983 to protect women.
The law as it stands on date – a woman can lodge a criminal complaint against her husband and every single member of his family, after which, the man along with old parents, even married sisters and their husbands, have to run around courts pleading to be not guilty.
However, the case below, will also demonstrate how misuse of this law happens with full confidence, when men in power are themselves guiding and aiding women to file false cases against their husbands.
Case:
A woman was caught red handed on Friday by her estranged husband, while she was enjoying coffee at a cafe with a police constable. The woman had filed a case of Dowry Harassment against her husband and has been living separately since past 3-years.
Allegedly, the woman is having an affair with not one, two…but three constables from the same police station, where her Dowry Harassment case has been lodged. The matter pertains to Balotra in Rajasthan.
Background:
34-year-old Jagatpal, a resident of Balotra, got married in the year 2015 with a woman from the same city. The husband is working as a lecturer at Mulji ki Dhani, while the wife holds a B.Ed degree. Everything was fine for initial four years.
However, in 2019, wife filed a case of domestic violence and maintenance against her husband. Since then, both have been living separately.
The wife has registered total of 7 cases of dowry harassment and assault at the Balotra police station. In the maintenance case, the Balotra court in May 2022, had ordered husband to pay Rs 7,000 per month.
Husband Catches Wife Red Handed
On Friday, while chasing his estranged wife, husband reached the cafe, where he caught her red handed with one of the constables named Sandeep Chaudhary.
When Jagatpal snatched Sandeep’s mobile, he recovered several chats between his estranged wife and the constable.
Husband Approaches SP For Justice
The husband then approached the Superintendent of Police, Deepak Bhargava and informed him about the involvement of his constables.
Jagatpal alleged that his estranged wife was involved in illicit relations with three constables – Sandeep, Nandu and Durgaram – from the same police station, where she had filed a dowry harassment report.
Husband further alleged that he was being constantly harassed by his wife along with these constables.
SP Bhargava has summoned Constable Sandeep and assured action, against him or any other constable, is found guilty.
Wife Plans Attack
After being caught red handed, the wife even planned a physical attack on her husband, while Constable Sandeep has switched off his phone and absconding since Friday.
Incidentally, Durgaram is already under suspension after being caught in another Spa extortion case, few months earlier.
