Abuse has no gender. This has been affirmed once again through a May 17, 2024 Madhya Pradesh Court that instructed a woman to pay monthly maintenance for the upkeep of her elderly mother.
According to an Indore Court, the woman had shunted out her senior citizen mother from their home during COVID-19 lockdown, reported PTI.
Case:
A 78-year-old woman approached the family court in Indore against her only child accusing her of torture and financial abuse. The petitioner claimed that her 55-year-old daughter had not just thrown her out of her home during the horrific lockdown period, but also grabbed all her savings.
Allegations by Senior Citizen Mother
The petitioner claimed that her daughter started harassing her and threw her out of the house without any reasonable explanation in March 2020 when the government imposed the lockdown during the COVID-19 outbreak.
The mother then informed the court that her daughter ran a saree shop at her house and earned somewhere between Rs 20,000 to Rs 22,000 per month. The woman’s husband (father of respondent), who was a driver with the state road transport corporation, died in 2001. Following his death, the daughter had lured her into selling their ancestral house and invited her to live with her family.
However, the mother alleged that her daughter gradually withdrew the provident fund of her husband and also took the proceeds from the sale of the ancestral house from her bank account, on the promise to take care of her completely.

Additional Principal Judge Maya Vishwalal of the Indore Family Court went through the evidences and ordered the respondent daughter to pay Rs 3,000 per month as maintenance to her septuagenarian mother. The order read:
Based on the evidence produced on behalf of the applicant, it is proved that the respondent (daughter) ran a shop with her son at her house. It is thus clear that she earns an income and can maintain her mother.
Speaking with PTI, Shail Rajput, who represented the elderly mother said:
We mainly argued before the family court that when a woman can claim equal rights over the property of her parents, it is also her duty to take full care of her elderly parents.

- When we speak of domestic violence or domestic abuse, we always visualise an image of a man beating or harassing a woman
- However, abuse has various faces, and women too, can be equal perpetrators of a crime
- In this case, the elderly woman could seek justice under the Senior Citizens Act, 2007, however, married men have no such law against their wives, if they are in similar situation
- The approach of most women rights NGOs is equally appalling when the victim and perpetrator, are both women
- Sadly, their activism is limited only to bashing and looting the men, but are happy to look the other way when situations like these emerge
- Unless mindset of society becomes gender neutral, it is hopeless to expect the government or people in power to amend any gender specific laws
