INDIA 2022 | Lucknow Man Seeks Divorce On Ground Of Wife Swapping

In an unusual development in the Family Court of Lucknow, a husband filed for divorce from his wife on Wednesday, following the latter’s gradual estrangement from him as a result of a case of wife-swapping between two couples.

Rajesh and Dinesh (fictitious names) were close friends in college and began swapping wives after they married. According to information, the situation changed when Rajesh’s wife became more attracted to Dinesh after several mutually agreed-upon incidents of swapping.

Rajesh, according to reports, couldn’t stand the estrangement and eventually filed for divorce from his wife. The wife’s cruelty has been cited as the reason for the divorce in this case. According to information, the case is complicated because the act of swapping between the four individuals was done with mutual consent.

Speaking on the subject a Senior Lawyer stated that such cases were extremely rare.

When these cases come up, we sometimes don’t realise it’s a wife swapping case at first. The arguments are presented when the case is fought and the debate becomes heated.

It is usually at this point that the true reason for the case emerges. Because people rarely speak the truth, such incidents reflect a person’s personality. Both husband and wife use their husband’s and wife’s cruel behaviour as shields.

Cruelty between husband and wife is mentioned in Section 311 of the Hindu Marriage Act. When defining cruelty in marriage, one must consider the gravity of the situation as well as the allegations. They must also consider the type of cruelty and the number of times the act has been repeated.
