In a shocking incident reported from Dehradun in Uttarakhand, a 23-year-old HIV+ woman was arrested for allegedly sexually assaulting her 15-year-old nephew with an intention to infect him with the virus.
The woman has been booked under Sections 270 of the IPC and 5 and 6 of the POCSO Act.
Case:
On April 2, the woman was caught by the boy’s mother while she was allegedly threatening him.
According to the police, when the mother confronted her son, he then narrated his ordeal. On the same day, both parents lodged a complaint against the woman at a local police station.
Statement by Police
Cops in Uddham Singh Nagar, Uttarakhand, said that the woman was nabbed on the basis of a complaint filed by the boy’s family on Saturday, after which she was produced before a local court that sent her to jail on Sunday.
Sub-inspector Reeta Chauhan, who is investigating the case, told TOI that the woman first sexually assaulted the boy last month, a few days before Holi. Chauhan said,
Her husband died of AIDS last year in December, after which she had gone to her village in Pilibhit, UP. As per a mourning ritual, her nephew (son of her husband’s elder brother) had gone there last month around Holi.
There she sexually assaulted him repeatedly before he returned home.
On March 30, the woman visited Udham Singh Nagar to see the boy again and ended up sexually assaulting the minor child on several occasions. She threatened him of dire consequences if he informed anyone.
Police sources said the woman was “envious” that her husband’s brother’s family was hale and hearty.
Based on the complaint, police registered a case against the woman under:
- Section 270 of the IPC for malignant act likely to spread infection of any disease dangerous to life
- Section 5 and 6 of the POCSO Act for aggravated sexual assault
The woman has been arrested since the victim was a minor. India still does not have Gender Neutral rape laws and no woman can be charged with rape or sexual assault on an adult male.
