Criminal Complaint Filed Against DCW Chief Swati Maliwal For Abetting Suicide Of Minor Boy

The ‘Bois Locker Room’ controversy is far from over. However, now the tables have turned and there is immense social media outrage to demand accountability from people enjoying positions and power, but acting without basic investigation in any matter against the male gender.

Background

A girl from south Delhi shared a screenshot on social media exposing the ‘Bois Locker Room’ group and scores of similar groups. She also shared the screenshots of the list of participants in the group and that of their chats where the said persons are seen sharing pictures of girls and passing lewd comments over them.

Delhi Commission for Women Chief Swati Maliwal promptly accepted whatever had been shared on an online platform and started making comments without even any inquiry. She then quoted,

I saw screenshot of ‘Bois Locker Room’ group on Instagram. This is a clear example of a gruesome criminal and rapist mindset. We are issuing a notice to Instagram and Delhi Police. All the boys in this group should be arrested.

Later in its notice to Instagram, the women’s body asked the photo sharing platform to provide information about the administrators and participants of this group including username/handle name, email ID, IP address, location etc.

Maliwal also quoted,

These were the same people who were making plans to gang rape girls and were making objectionable comments about them. Such persons, irrespective of where they are and whether the lockdown is in place or not, should not be spared.

Further Maliwal also asked the society to support all such girls – even before the boys got a fair chance to share across their side of clarification. She said,

If they are facing any issues, they can approach the DCW and we will help them. I appeal to society to support such girls.

The Delhi police had taken all the members of the bois locker group in custody and initiated investigation against the Instagram chat group.

However, within a week, fresh development in the controversy revealed that one of the snapchat conversations shared as a part of the group was actually between a girl and a boy. The girl sent messages through a fake account named ‘Sidharth’ to check on a boy. This was not even a part of the instagram group chats in question.

While the day-long male bashing was trending in mainstream and social media, another minor boy (not related to bois locker room) was named in an alleged #MeToo instagram post. The boy amidst pressure mounting from all sides, combined with the hysteria around bois locker room, ended his life last week in Gurugram.

Since the truth has been revealed by Delhi police that there were NO Rape threats issued by any boy in the matter, several activists have been demanding toughest action on Maliwal for her alleged careless approach in the entire matter.

On May 11, Advocate Chandni Shah has filed a criminal complaint with Delhi Police demanding the arrest of Swati Maliwal on charges of Abetting Suicide of a Minor Boy. Shah tweeted her complaint stating,

DCW chairman @SwatiJaiHind widout investigating publicised names of the minors,thus instigating a minor student to commit suicide.The disobeyance of law attracts punishment regardless of who is the offender.I have thereby, filed a complaint with @DelhiPolice against @SwatiJaiHind

Part of the complaint reads as below:

Without any investigation, without any proofs, Swati Maliwal disclosed the information about the minor accused to public which led to abetment and death of minor student. 

I, as law abiding citizen of India, ask for a stringent action to be taken against Chairperson of DCW, Swati Maliwal, for Abetment to Suicide u/s 305 and 306 of IPC, for publishing identity of minors u/s 228A of IPC and for misusing her power of designation and authority u/s 166 of the IPC.

This is not the first time Swati Maliwal has come under fire.

In January 2018, a city court has asked Delhi Police for the Action Taken Report on a criminal complaint filed against Delhi Commission for Women chief Swati Maliwal. The complaint was filed by lawyer Pradeep Rana on behalf of an 18-year-old girl, who studies in Class XI and lives in Narela.

The complaint alleged that Maliwal used ‘caste-based slurs’ against the girl and her family, and seeks registration of an FIR under SC/ST Act and for trespassing.

In another incident in 2016, a case under sections 13(D) of Prevention of Corruption Act, 409 (criminal breach of trust) and 120B (punishment of criminal conspiracy) of the IPC had been registered against Maliwal, in connection with alleged irregularities in recruitment in the women’s panel.
