A woman in Bengal lodged a complaint against a man, who was barber by profession, that he had sexually assaulted her eight-year-old daughter. The complaint had been lodged in the Phoolbagan police station, West Bengal.
A city court in August 2018 had sentenced the woman for two months since the alleged sexual allegations against the 40-year-old barber proved to be false and fabricated. The lady had accused the man for sexually assaulting her eight-year-old minor daughter.
The POCSO (Protection of Children from Sexual Offences) was misused when the woman accepted that she had used her rights for the false cause. The woman admitted in front of the court that she had levelled false allegations against the man under the POCSO act during the examination of witnesses in the case.

The woman had lodged a complaint at the Phoolbagan police station, saying her daughter had been sexually assaulted by the barber at the time of getting a haircut from him. The barber was immediately arrested after the woman’s complaint against him.
The mother was being questioned as a witness in the trial in front of the Special Judge, Jimut Bahan Biswas at Sealdah Court, wherein she accepted that she had made false allegations against the innocent man, said the Public prosecutor, Vivek Sharma.
While she admitted she had made allegations in a confidential statement before a magistrate, however, she did not reveal the reason behind her doing this. She did not disclose any reasons for her action to the court, said Sharma.

The judge cleared the man with all charges made on him and ordered his release. The judge then proceeded towards sentencing the woman with two months imprisonment for the false allegations she made on the innocent man. This is also because the man himself was behind the bars for many months due to her false allegations.
The public prosecutor Sharma argued that there is a provision of sentencing a person up to six months in jail for filing false charges under the POCSO act. The woman later was taken into custody and sent to a correctional home.
