Feminists and Women’s Rights Activists often question, how many false rape cases are filed against Men? Instead of demanding strictest action against false accusers, the falsely accused Men are often shamed.
Below is one such case from Thane, Maharashtra, where a young man spent 7-years in jail in a false rape case. All these cases go unnoticed by mainstream media, which is not just a violation of Men’s Rights, but sheer abuse of basic Human Rights in India.
Case:
34-year-old Vipul Narkar, resident of Dombivali, Thane, spent seven years in jail on charges of raping his 15-year-old step-daughter. However, after spending nearly a decade in jail, he has been acquitted by the Kalyan sessions court.
Background:
In 2014 Vipul got acquainted with a divorcee and subsequently married her. The woman had two children from her previous marriage – 15-year-old daughter and 13-year-old son. After marriage, Vipul shifted his wife and children into his Dombivali flat.
In 2015, Vipul had caught his minor step daughter twice with a boy and scolded her. The girl attempted suicide and was admitted to a hospital where she gave a statement to the police, that her stepfather had sexually assaulted her.
Based on her complaint, Vipul was arrested for rape under Protection of Children against Sexual Offences Act (POCSO). The accused had no money and could not fight his case and continued to remain in jail.
Statement By Lawyer
Speaking exclusively with Hindustan Times, Vipul’s lawyer Ganesh Gholap, who met him at Adharwadi jail in 2018 said,
I noticed Narkar was well behaved with everyone and helped most inmates in small chores like writing applications. He had a very beautiful handwriting and was fluent in English. I was intrigued and wanted to know his story. I started talking to him and hearing him out, decided to take his case.
In 2019, I filed an application in the court and the proceedings began. However, they were stuck as the pandemic set in.

Adding further Gholap said that the defence questioned 12 witnesses in the case including the girl, her three male friends, her principal, medical officers and neighbours. Gholap added,
Her medical report did not show any signs of sexual assault. Her parents or school principal could not provide her birth certificate to prove that she was a minor at the time of the incident. We then decided to cross examine the girl. She told us that they sold the house brought by Narkar in Dombivli and went to live with her real father.
She also told the court that her boyfriend refused to marry her and thus she attempted suicide. She got scared that Narkar would scold her for trying to elope.
She used to watch a popular crime drama from where she got an idea to frame her step-father so that her parents too could reunite. She told the plan to her parents who agreed, she told the court.
Gholap took up the case without charging any fee.

Girl Cannot Be Punished As She Was Minor, Will Approach Human Rights Commission
Gholap told TOI that the girl cannot be punished for filing a false rape case as she was a minor at the time. However, Gholap is determined to take up this matter and thus he said,
Now that Narkar has lost his all, I will approach the Human Rights Commission to get financial aid for him.
The lawyer is also trying to find out how Narkar’s wife managed to sell his house without his permission while he was in jail. Narkar, on release from jail, lives in the lawyer’s office.
