The Mumbai police arrested a senior officer working with the Tata Institute of Social Sciences (TISS) for allegedly raping a staff member. According to the complainant, she was raped on multiple occasions by the educational officer on the promise of giving a job to her brother and the husband of her sister and later by threatening to terminate the services of her brother.
Case:
Sanjay Shah works as a deputy registrar at the institute. The complainant woman also works at TISS.
According to the allegations, the accused had promised jobs for the complainant’s brother and her sister’s husband at the same institute. Later, she and the accused went to Delhi and Hyderabad, where she alleged the accused had physical relations with her without her consent, reported TOI.
The accused allegedly even threatened to fire her brother and also take revenge on her family. Not just the accused, but the accused’s wife also allegedly threatened the victim that she would send her photo with her husband to their office. Accordingly, the complainant then approached the Trombay police and filed an FIR.
Police Action
The Trombay police has booked the senior officer under Sections 376 (rape), 376(2)(n) (raping the same woman repeatedly), 354D (stalking), 501 (printing or engraving matter known to be defamatory), 504 (intentional insult with intent to provoke breach of peace), 506 (criminal intimidation) and 34 (common intention) of the Indian Penal Code (IPC). He was arrested on Sunday and produced before a metropolitan magistrate court which remanded him to police custody till March 27.
Action by TISS
The officer has been suspended soon after the institute received the sexual harassment complaint. Speaking with Hindustan Times, the administration representative said:
The female staff submitted a copy of her complainant to us, following which we have immediately suspended the officer.
If #MeToo Accused Can Become Punjab CM, Why Should Common Man Resign Until Allegations Are Proven?
Voice For Men India Opinion:
- No one must be lured or forced into sexual relations on pretext or promise of something
- If the man is in a position of power, surely, he will be presumed guilty, even at times where the relationship had been consensual
- While the officer here will face his fate after the investigation is complete, why are no questions raised on an adult female colleague traveling with him on promise of job offers for her family members
- In our humble opinion, the woman is equally a party to such sexual exploitation, because she allows the man to take advantage of her in exchange for something
- In most cases, where such arrangements fail, it is only the man who is accused of rape and intimidation
- Our comments above may be treated at a macro level, since the investigation in the current matter is still underway
