Everyday we come across a new case with regards to the misuse of Gender Biased Laws and Special Rights to Women. Such cases throw light on how loopholes in the system are exploited by some women to gain advantage citing their gender.
In a unique story that has been reported from Rajasthan, a woman wanted to take advantage of ‘divorce quota’ for getting selected in the UPSC exam. Initially she planned her marriage, then sought divorce from her husband, only to acquire the status of a ‘divorced woman’.
When efforts from the husband to convince her change her mind failed, he approached local police for help.
Case:
Ravi (name changed) in this case is a resident of Jaipur and a photographer by profession. He met Neetu (name changed) in 2013 while he had visited Pratapgarh during a photo shoot event. In 2016, Neetu shifted to Jaipur for further studies and since then remained in contact with Ravi.
Later, the duo also got into a live-in relationship and it was Ravi who funded all their expenses, including the fees of competitive exams for which Neetu had been preparing.
In 2021, the couple got engaged with the blessings of their families in Pratapgarh and in September 2022, Neetu got a government job under the Tribal Sub Plan (TSP) quota. After getting this job, Neetu wanted to pursue further studies to clear her UPSC exam as well. This is when Neetu backed out from marriage.
However, after somedays, Neetu called up Ravi and informed him, that she was ready to marry him, only if he would support her in clearing the UPSC exam.
Marriage
After Ravi agreed to all demands from Neetu, bought her various items as per her request, the couple got married in February 2023 at Pratapgarh as per Hindu rites and rituals.
Post the wedding, Ravi brought Neetu back to his home in Jaipur and after the initial marriage ceremonies were concluded in the matrimonial home, Neetu instantly asked for divorce.
The wife returned to her parental home on the very next day of marriage, and informed her husband that they would live separately for a year, and then file for mutual divorce. Neetu also reminded Ravi that he had promised to help her in every way to clear her exam and thus, now it was his duty to do so.
This was all pre-planned to take benefit of the divorce quota for women during UPSC exam selection.

Asked For Divorce On 1st Anniversary
Within 1.5 months of the marriage, Neetu stopped all communication with Ravi. Anytime the duo would chat, the wife would only insist on husband giving her a divorce.
After completion of one year, Ravi visited Neetu’s home in Pratapgarh to celebrate their first anniversary. When Ravi once again refused to consent for mutual divorce, Neetu summoned the local police, threatened to implicate Ravi in false cases and send him to jail.
By now, Ravi realised how he had been trapped and subsequently, he approached Kardhani police station in Jaipur to file a complaint against his con wife.
Update: The wife has now filed a case of dowry harassment against her husband in Pratapgarh. According to a report by ETV:
The complainant’s wife however had a different story to tell. She has accused the man of harassing her for dowry and luring her for marriage through emotional blackmail. She said that a case of dowry harassment was registered against her husband in Pratapgarh district.

Tribal Sub-Plan (TSP)
Tribal Sub-Plan (TSP) aims to bridge the gap between the Schedule Tribes (STs) and the general population with respect to socio-economic development indicators in a time-bound manner. It is a part of the annual plan of a State or Union Territory.
Last year in a similar case, a bench of Justices Kuldeep Mathur and Sandeep Mehta of the Rajasthan High Court had emphasised on the essentiality of a decree of divorce for a female candidate, to claim reservation against the reserved quota for a divorcee. The High Court had clarified how a decree of divorce must be granted by a competent court and exemption from presenting a decree of divorce issued by competent court could not be sought on the ground of customs prevalent in their respective communities.
