Rape laws had been made extremely stringent after the unfortunate incident of Nirbhaya in 2012. However, many women and men are misusing these laws today to their advantage, largely to fix innocent men or extort money.
One such case has been reported from Mumbai, where two men were arrested by Sahar police for assaulting a Kandivali based businessman and trying to extort Rs 10 lakh by threatening the victim with a false rape case.
Background:
The victim in this case is a 47-year-old businessman from northern suburbs in Mumbai. He was acquainted with one Irfan Ramzaan Shaikh through business transactions.
On Tuesday, Shaikh invited the victim to watch a cricket match with him at a five-star hotel near the airport. According to the victim and statement given to the police, he reached the hotel at around 10.30 pm and found Shaikh along with a woman named Pooja in the room.
The three had dinner and watched the match together. However, Shaikh later left the room citing work while Pooja came onto him.
The businessman alleged that while he was trying to push Pooja away, Shaikh and his associates Parag and Arun barged into the room. The accused then demanded Rs 10 lakh from him, failing which they threatened to file a false rape case against him, reported Mid-Day.
As the victim refused to pay, the accused left the room.
Victim Approaches Police
The businessman then left the hotel around 11 am next day, and approached Sahar police. Sanjay Govilkar, senior inspector, said they registered a case against Shaikh and his accomplices under:
- Section 323 (voluntarily causing hurt)
- Section 385
- Section 388 (extortion)
- Section 504 (intentional insult)
- Section 506 (criminal intimidation)
- Section 34 (common intention)
…of the IPC. Govilkar added,
We arrested Shaikh and two of his associates late on Wednesday. We are on the lookout for his female accomplice.

- As a man, if you find yourself in similar situation, do not panic
- Approach the police at once and submit all details and evidences in place
- Do not fall for blackmailers trying to extort money by threatening implication under women centric laws
