Wrongful arrest of any person must have consequences. Unless there is stern against against the law and order officials, there is no accountability to compensate for the loss of years, any individual spends as accused.
In a recent case reported from Karnataka, a local court in Mangaluru has slapped a fine of Rs 5 lakh on police for arresting a wrong person on charges of rape under POCSO. The accused man spent one year in jail.
Case:
A person named Naveen was accused in a case of rape of a minor that took place in the Mangaluru rural police station limit. The victim girl had mentioned about one accused Naveen in her statement before the magistrate, however, the police wrongly arrested some other person whose name was Naveen Sequera.
According to the girl’s statement, Sub-Inspector Rosamma P.P had registered a case under the POCSO Act against the accused named Naveen and handed over the further investigation to Police Inspector Revathi.
During the investigation, Revathi, made a person named Naveen Sequeira an accused and submitted a charge sheet to the court.

Arguments by Accused
The counsels who represented Naveen Sequera informed court that the girl had indeed named Naveen and also submitted all documents, where the age of the alleged accused was 25 to 26 years.
However, It was brought to the notice of the court that Naveen Sequera – arrested by the police – was 47-years of age.
It was argued that the police had thus arrested wrong Naveen, who had also undergone judicial custody for one year.

As reported by IANS, after going through the evidences on record, the District Second Additional FTSC POCSO Court announced the verdict and asked Inspector of Police Revathi and Sub-Inspector of Police Rosamma PP to pay a fine amount of Rs 5 lakh from their salaries for arresting the wrong person of the same name and keeping him in judicial custody for almost a year, in the said POCSO case.
The court has ordered this amount to be handed over to Naveen Sequera.
Not just fine, but the judge also ordered the Principal Secretary of the Karnataka Government’s Home Department to take legal action against both police officers.

- This is not limited to investigation by police officers, but also the evidences referred to by the court, before sending the person to judicial custody
- There are millions of under-trials languishing in jails of India – who do not even get a hearing for years
- Unfortunately, due to an overburdened system, many accused are dead before being pronounced as guilty/not guilty
- This is why there is an urgent need to fix accountability at every stage – jail women who file false cases, make police accountable for accurate investigation
