A Delhi court granted bail to a man accused of raping a woman and also allegedly assaulting her family members. The court, after a detailed police investigation, concluded that there were numerous calls exchanged between the two and the woman was in a consensual relationship that later failed.
Case:
Titu Bhati was charged with rape and physical assault of complainant’s family members. In the FIR, the woman alleged that Bhati traced her mobile number from somewhere and forced her to have a physical relationship with him. She further added that the accused also assaulted her family.
The man had been lodged in judicial custody since 10-days.
Delhi Court
The complainant is a 39-year-old married woman with three kids and the accused man is also married. There had been an exchange of 1300 calls between the two, of which duration of some calls exceeded 2232 seconds.
The court concluded that such details only proved that the complainant could not have been forced in such a relationship and she was an equal party to the same. Also, both being married were fully aware of the consequences. Later, the woman in her statement to the judicial magistrate admitted that she was in a mutual relationship with the accused.
The court added that the investigating officer denied any charges of assault on her family either. Moreover, the woman had not supported her accusations with any medico legal report, which became a serious matter to deny bail to the accused.
Additional Sessions Judge Devender Kumar said,
The call duration has been running sometimes up to 2,232 seconds. In fact, over 1,300 calls have been exchanged between them, which proves that the relation was not against her wishes. Moreover, she is 39-year-old and married with three children, while the accused is married too. Both were aware about the consequences of such relationship.
Bail Granted
Additional public prosecutor R K Satyarthi, appearing for police opposed the bail plea stating that Bhati had forcefully got the woman involved in the relationship and also beaten up her family members.
Advocate Pradeep Teotia appearing for the accused man said that his client had been falsely implicated in the case and was in jail since June 29. The bail was granted after furnishing a bond of Rs 50,000 with one surety of similar amount and also accused was instructed not to have any contact with the woman or her entire family.
