After #MeToo Allegation Against CJI Ranjan Gogoi, Several Supreme Court Judges Asked For Male Staff

As India is discussing #MaritalRape Law debate, which will be solely based on “testimony of wife”, let us rewind what happened after Former Chief Justice of India, Ranjan Gogoi was accused of sexual harassment by a woman employee at Supreme Court.

MDO is not taking sides in the case, but merely pointing out repercussions of possible tsunami of misuse of the Marital Rape Law, if it goes through.

All cases are not false, but all case are not genuine either. This was the fear amongst Supreme Court judges back in 2019.

Here’s What Had Happened:

After an unprecedented sexual harassment charge by a dismissed woman employee of the Supreme Court against Chief Justice of India Ranjan Gogoi in 2019, many SC judges requested all male staff at their residential offices.

As the then CJI had expressed his anguish and explained the fallout of the “motivated” complaint against him to SC judges at the customary morning meeting, many did expressed solidarity with him.

The meeting had lasted for close to 20 minutes and CJI Gogoi said he had received requests from judges for posting only male staff at their residential offices, to avoid a potential situation of the kind in which the CJI found himself in.

Challenges

The CJI said the request for male staff at residential offices was difficult to meet as 60% of the SC staff were women. Some judges expressed apprehension about employing female law clerks, who like their male counterparts work mostly in residential offices till late hours preparing summary of case files listed for hearing in the next few days before the judge concerned.

Chief Justice Ranjan Gogoi told Supreme Court judges that this issue should be debated to devise ways and means to protect future CJIs and SC judges from what he called scurrilous attacks.

Many judges shared their concern with TOI and said the allegation that the CJI had invited the dismissed junior court assistant and her husband to his home for lunch and to his swearing-in ceremony on October 3, 2018 appeared a bizarre attempt to show her closeness to the CJI. A judge then asked,

When the CJI had invited all the staff members with their spouses to the lunch and for the swearing-in ceremony, what is so special about this gesture being extended to her?

Some judges said they were aware of women law clerks providing valuable assistance to judges in their residential offices, be it for research purposes or for making summaries of case files. They then quoted,

Since all the law clerks work till late evening, they have almost become part of the family and are often invited to have lunch and dinner at the residences of the judges. Would it be counterproductive in future? We are not sure now.

Now, if a Chief Justice of India claimed he was trapped in a false sexual harassment case, where will it leave common man – whose disgruntled wife will be empowered to just file a Marital Rape complaint against him to settle scores with him or in-laws, or perhaps negotiate the best deal for alimony.

Feminists have given a spin to anyone who questions misuse, checks in place before randomly passing such one sided law in favour of wives. The minute you would dare to question the other side, they label all “Men as potential rapists, waiting for a license to rape their wives.”

Its time to express yourself, be vocal and speak up as there is no shame in discussing pros, cons and equal balanced rights for our gender.
