One of the reasons to start Men’s Day Out – portal covering stories about Men’s Rights and Gender Biased Laws – was to bring out the gross injustice Men face in India purely because of being the male gender. Crimes against women is a reality which no one can overlook, however, to protect 50% of our population (women), we as a country have left the other half without any legal recourse, until they spend years and decades in courtrooms trying to prove their innocence.
On similar lines, some Advocates and Law Students have now written an elaborate letter dated June 23, 2021, to the Honourable Chief Justice of India, urging the Apex court to take Suo moto cognizance and direct the Law Ministry to formulate law governing cruelty against Men in order to eradicate their helplessness and to fill in the lacuna in the law.
The letter published by Latest Laws highlighted that Supreme Court being the watchful guardian of the fundamental right of equality must take note of how the cruelty against men both physically and mentally in the modern day is increasing rapidly. The remarks in the further also presented an overview of the current scenario with regards to the Anti-Dowry law – Section 498A of the Indian Penal Code, which fails to qualify the test of gender neutrality depriving aggrieved man of his legal remedy. The object of Section 498A was to protect the women from the harassment caused to them due to dowry and which sometimes led to their death.
The letter argues that the present-day statistics tell us a different story where women’s suicide is reduced by 2 percent, while male’s suicide has increased by 48 percent. The letter also emphasised the NCRB Suicide Report 2019 which stated how India loses 11 Men every hour Vs 4 Women every hour. The letter further pointed out the case of a tribal man who was killed by his wife’s family on his failure to pay them Deja (reverse dowry). Lastly, false allegations against Men under Section 498A were also highlighted in the present letter.
In the light of the above, the letter highlighted the fact that #CrimeHasNoGender, and that law should be equal for all. The letter thus stated that the laws in India must recognise that Men too have mental burnout, that men too are subjected to Cruelty. Thus appropriate legal recourse in their favour must be taken to eradicate their helplessness and to fill in the lacuna in the law.
