On Thursday, ANI reported that a woman had been allegedly raped while undergoing treatment at the ICU of Fortis Hospital in Gurugram.
Usha Kundu, ACP Gurugram Police, said that a 21-yr-old woman admitted to the said hospital was allegedly violated by a man during her ongoing treatment. Kundu then quoted:
Case registered at Sushant Lok Police Station. Probe on. Victim is not in the state to give her statement right now. CCTV footage being examined.

A member of the Fortis team also confirmed saying,
She was admitted on 21 Oct with respiratory symptoms & Pulmonary TB. From 2nd day of admission she has been on ventilator. 6-days post-admission, she alleged she was violated on day of admission. We informed police immediately

Police said the woman has been admitted to the hospital since October 21, and has been in a semi-conscious state on ventilator support. As reported by The Indian Express, Inspector Bijender Singh, SHO of Sushant Lok police station, where the FIR has been lodged, quoted:
A First Information Report (FIR) has been registered regarding the matter under IPC Section 376 (punishment for rape). She has accused a person named Vikas of the crime, so we are questioning all those employed at the hospital with that name.

Adding further, Singh said,
We are also scanning CCTV footage from cameras installed at the hospital but are yet to find anything suspicious. The accused has not been identified, and we have not been able to take the victim’s statement since she is unfit to give one. She alerted her father to the incident through signs and by writing the name of the accused. We are investigating the matter.
Fortis Hospital, in their official statement released on Thursday, said they are “extending full cooperation” to the investigation. The statement read as follows:
The patient came to the hospital on October 21 with severe respiratory symptoms and pulmonary tuberculosis. She was admitted to the ICU and from the second day of her admission, she has been on ventilator support. Six days after admission, the patient alleged she had been violated on the day of admission. Post her complaint, we immediately informed the police.
Fortis has been fully cooperating with investigating authorities. The entire CCTV footage and all other relevant information were shared with police. We understand that police is questioning two persons, who are outsourced non-medical staff. As per established protocol, they were hired after requisite verification. We have a zero tolerance policy against such situations and are committed to ensure that justice prevails,” said the statement.
Latest Development
The Gurugram Police is planning to quash the FIR it had filed in relation to the alleged rape, after recording the patient’s one-page statement on Saturday. The police noticed discrepancies in the woman’s statement and took the decision of quashing the FIR.

Patient Misunderstood ‘Intubate As Intimate’
Initially, the woman had alleged that she was raped by a member of the staff when she was semi-conscious. However, when the statement was being recorded, the woman alleged that three members of the staff had taken her for an X-Ray in the basement where they told her that she was pregnant.

The three staffers, including a woman, said that she (patient) assumed she had been raped after the staffers asked her if she was pregnant. The woman added that her X-Ray was conducted through a portable machine kept inside the ICU, in the presence of a woman.
The staff, however, said that the staff asked the woman if she was pregnant before the X-Ray and used a technical term ‘intubate’, which she misheard as intimate. The staff also said that they used ‘exposure’ but the woman mistook it as ‘expose’.
‘Allegations Incorrect’ – Gurugram Police
As reported by Times Now, Usha Kundu has now affirmed,
Her allegations were found to be incorrect and she gave contradictory statements and said that she is not sure if she was sexually assaulted.
The 21-year-old patient had handed over a note to her father, informing him about the alleged rape, following which, a complaint was filed. The police had initially arrested a staff member, based on the allegations made by the woman. The Haryana State Commission for Women (HSCW) took suo moto cognizance of the case soon after it came to light.
