A 15-year-old boy has been booked for allegedly raping a 21-year old woman on the “pretext of marriage” on Wednesday. Do note that the boy here is a minor, and as per the POCSO Act it is illegal to have physical relations with anyone who is a minor.
A police officer said,
We acted on the complaint of the woman. A report was filed and we informed the kin of the accused minor to shed light about the sequence of events in the Sector 43 District Court and before the Juvenile Justice Board. As the suspect is a minor, the case will put up before the Juvenile Justice Board.
What Does the POCSO Act Say?
3(a)(2) Whoever commits penetrative sexual assault on a child below sixteen years of age shall be punished with imprisonment for a term which shall not be less than twenty years, but which may extend to imprisonment for life, which shall mean imprisonment for the remainder of natural life of that person, and shall also be liable to fine.
It has not been established how the 15-year-old kidnapped the 21-year-old woman or forced her to elope. The reason given while filing rape is once again “on pretext of marriage, which clearly suggests that the relationship was a consensual one. Secondly, there are no charges pressed on the adult woman for mutually eloping with a minor and also having physical relations with him.
