An 18-year-old boy from Kerala, accused of raping and impregnating a minor girl, was granted bail by the court after the DNA test proved him innocent. The boy was granted bail after he spent 35-days in jail.
He had been remanded in judicial custody on June 22 under the Protection of Children Against Sexual Offences (POCSO) Act, after the complainant girl accused him of raping her while she was on her way back from school.
Case:
A student of Standard XII spent more than a month in jail, after he was booked under the Protection of Children from Sexual Offences (POCSO) Act. However, the Malappuram POCSO court granted him bail on Saturday, August 28, after a DNA test concluded that he was not the father of the child.
The arrest had taken place after a 17-year-old girl accused him of raping and impregnating her.
Statement to Media
Speaking to the media on Sunday, the college going student who hails from Tennala near Tirurangadi in Malappuram, said that he was mentally tortured by the police and one of the officers had slapped him on the face, after which he was not able to hear properly for a few days, reported The News Minute.
He and his parents also told the media that he was arrested around 12.30 am, without the police telling them the reason for the arrest. The young man said that only after reaching the police station, he came to know about the charges against him. He added,
I knew that I would come out of jail, because I did not commit any crime. I am only sad about the statements given by them (the girl) against me. Those were all lies. I have gone through hell, but now I am relieved.
He added that the girl was known to him since a year as they were from the same school, but did not assault her. However, police told PTI that he was picked up after the minor girl who was hospitalised, gave a statement against him.
Police Statement To Media
The police informed media,
The girl gave the date of the incident and the location, which is apparently his house. She gave the statement against him to the doctor, woman police officers and a statement to the magistrate under Section 164 of the CrPC.
The investigation is still ongoing and that there was one more accused in the case, who is absconding, according to police.
Such cases demonstrate the other side, which is anti social media activism, where capital punishment or castration is demanded on the spot for the ‘accused’, once he has been nabbed. MDO is strictly not justifying or shielding any convict. Our focus firmly remains on the numerous false cases filed against boys/men, that can ruin their lives forever.
In almost all cases, there is no repercussion on the girl/woman who gives false statement or registers a false complaint.
