BSP MP Atul Rai from Uttar Pradesh got relief in a rape case after the matter reported by the woman at the Varanasi’s Lanka police station turned out to be fabricated.
The court has now ordered registration of a case against two people, including the woman who lodged this false complaint against the MP.
Case:
A week after filing nomination from Uttar Pradesh’s Ghosi parliamentary constituency as BSP candidate on April 26, 2019, Atul Rai had landed in trouble, when a Ballia girl lodged a rape complaint against him with Lanka police in Varanasi on May 2.
In the complaint filed by the college girl, she alleged that the MP took her to a flat on pretext of making her meet with his wife and sexually exploited her. She also said that he was threatening her to keep mum after the alleged incident. Rai was arrested and sent to 14-days judicial custody in June 2019.
The accused woman, who is a resident of Kotwan Narayanpur (Narhi) in Ballia district, had filed a case against the Member of Parliament alleging serious charges of rape against Rai.

Pawan Kumar Singh, Rai’s brother, a resident of Veerpur (Bhanwarkol) of Ghaziapur district had filed an application under Section 156 (3) of the code of Criminal Procedure in the court.
The woman and her friend Satyam Prakash Rai of Laxmanpur allegedly colluded together to honeytrap the victim in this case.
Singh had filed a petition in the matter, and the court of Chief Judicial Magistrate SP Yadav found the rape complaint to be incorrect. Advocates Anuj Yada, Manish Rai and Vikas Yadav, who represented the accused, provided documents and evidence on Singh’s behalf in the court of Chief Judicial Magistrate in Varanasi.
Evidences Given
Singh provided copies of two mark sheets of the girl which had two different birth dates. The girl had also filed another rape case on a student leader at a UP College in 2015 and the details of the same with different birth date were submitted to the magistrate. Pawan’s lawyer submitted that this case against the student leader was also false and that her birth date mentioned in that case read as March 10, 1997.
However, she submitted her birth date as June 10, 1997 during her complaint against Atul Rai. Pawan said that the accuser was taking legal advantage by submitting false documents.

Subsequently, the magistrate order the Cantt police to register an FIR against the girl and produce a copy of the same in court.
Incidentally Atul Rai defeated BJP’s Harinarayan Rajbhar in the 2019 Lok Sabha Elections. Rajbhar is a supporter of Equal Rights and Gender Neutral laws and was a part of the Seminar demanding National Commission for Men in September 2018.
