False Rape Cases often come with zero deterrent for women, since in several such instances, courts overlook any conviction for the false complainant, after acquittal of the falsely accused man.
In a recent case reported from Ghaziabad, NCR, a fine of Rs 20,000 was imposed on a woman, for registering a false rape case against her neighbour.
A special court slapped the fine on the woman on Saturday.
Case:
In October, the woman had accused her neighbour, identified as Rajat, of raping her minor daughter at night. Based on her complaint, Rajat was arrested under various sections of the Indian Penal Code (IPC) and Protection of Children from Sexual Offences (POCSO) Act.
Rajat was sent to jail in October 2020.
Ghaziabad Court
While hearing the case, the court of special judge (POCSO Act), Mahendra Srivastava, found the rape allegation to be false on the basis of evidence during the the trial, according to a national daily report.
The court imposed a fine of Rs 20,000 on the woman. If she fails to pay the amount, she will get imprisonment for 15 days. Special public prosecutor (POCSO Act) Utkarsh Vats quoted,
The court also ordered that 50 per cent of the fine amount would be given to Rajat.
Our Take:
The man was in jail since October 2020 on charges of False Rape under extremely harsh section such as POCSO. After spending nearly 3-months in jail, all he gets is an acquittal and Rs 10,000 – half the fine levied on false complainant.
Recently, when Bombay High Court Nagpur Bench granted bail orders in POCSO cases, surely the same have been strictly as per evidence. However, if media bullies and intimidates judges for their bail orders, like in case of Justice Pushpa Ganediwala, people like Rajat would be in prison for life.
