Pune Family Court Orders Mother To Pay Rs 5,000 Fine Each Time She Misses Facilitating Visitation Between Father & Son (Representation Image Only)

The Pune Family Court has taken a bold step by warning a woman of a per day fine, if she happens to miss facilitate visitation of the child with her estranged husband.

In a unique order, the court has remarked that henceforth if the custodial parent (mother) misses out on the visitation date, she will be fined to a tune of Rs 5,000 per missed visit. 

Case: 

Soham and Rekha (names changed) got married in 2007. Husband is working as an engineer with a private company, while the woman, who is an engineer by qualification, is now a housewife.

After a few years into the marriage, there were constant arguments between the couple, due to which the husband started living separately.

The couple applied for divorce in the year 2021 and also the matter of child custody remained pending. 

Visitation of Child

It was brought to the notice of the family court that the wife – who held custody of the child – deliberately did not allow the husband to meet their son. Thus, the court granted visitation rights accordingly to the non-custodial parent (father). 

Pune Family Court

The court was informed that the wife was not allowing her estranged husband to meet with their child.

Furious to learn this, the Pune Family Court ordered Rs 5,000 as a fine for each missing visit, if she does not allow the husband to meet with their son.

Not just this, the court has also warned the woman that they will hand over the custody to the father, if she fails to facilitate visitations between her estranged husband and son in the next six months.
