Orissa High Court Withholds Human Rights Compensation Order Against Odisha Lady Officer

Remember the case of lady officer employed with Odisha police, when she was caught on camera thrashing a man inside the police station? The man was seen brutally beaten up when he had visited to report a personal dispute matter in May this year.

After huge uproar on social media, Odisha Human Rights Commission (OHRC) had ordered the woman police officer to pay interim compensation to the victim resulting due of police cruelty. The accused was identified as Sandhya Rani Jena, the inspector in-charge at Patna Police station in Keonjhar district when she was shot on camera beating the man with a stick and kicking him.

Orissa High Court Puts Compensation Order On Hold

On May 19, an order had been issued by the OHRC against Jena, the inspector in-charge (IIC) of Patna police station instructing her to pay Rs 10,000 as interim compensation to the man who was allegedly subjected to her physical torture. The order stated that the compensation be recovered from Jena’s salary.

However, Jena challenged the OHRC order that recommended the principal secretary, state home department, and director-general of police, directing the woman officer to pay the tribal man for her inhuman behaviour.

Court Observation

In the first week of June 2020, Chief Justice of Orissa High Court, Mohammad Rafiq said,

It is one of the cardinal principles of natural justice that any order which is likely to adversely affect a person ought to be passed only after providing an opportunity of hearing to the person concerned.

Justice Rafiq further continued,

Even though the order has been described recommendatory in nature to pay Rs. 10,000 as interim compensation to the victim and recover the same from the salary to the petitioner – Sandhyarani Jena, IIC, Patna Police station, but in the opinion of this court, the commission ought to have heard the petitioner who is a lady police officer serving as inspector of police.

Victim Demands Justice

The youth who was beaten up by the accused Sandhya Rani Jena, was identified as Raju Mahant, who hails from Talasarua village in Patna district. On March 25, he visited the police station with three others as he had a land dispute to be resolved. The police’s responsibility was to report the matter and direct them to go to court. However, instead of following the procedure, Raju was beaten mercilessly by Jena.

Mahant is now out on a bail and gave a statement, saying he was tortured by the cop without being at fault. He said,

The police inspector needs to be taken to task for her high-handedness.

On May 23, Abhay, Odisha DGP suspended inspector Sandhya Rani Jena on charges of ‘misconduct’. The official handle of Odisha police then tweeted,

DGP has placed inspector Sandhya Rani Jena IIC Patna PS of Keonjhar dist under suspension for her misconduct.

It was thereafter, the OHRC ordered to compensate the victim with Rs 10,000 from Jena’s salary. Nonetheless, the same has been put on hold by the High Court due to the court observation mentioned above.

Lack of significant punitive action against erring cops just encourages others to follow suit. In the bargain, common men suffer the brunt of hailing real life self appointed Singhams.

On other note, the principle of hearing ‘other side’ never exists in a domestic violence case, and interim maintenance is directly awarded to estranged wives — merely on their word and allegations.
