A 68-year-old man has sought protection from the Delhi High Court alleging harassment and domestic (physical) violence by his daughter. According to the petitioner, his daughter left her husband’s home and now lives with him, however, she has been allegedly harassing not just the father, but also all other members of the family.
Case:
According to the petitioner father, he has been constantly harassed by one of his daughters, who has left her husband’s home and now living with him. The petitioner alleged that the accused has assaulted him, his wife and his sister. The senior citizen man is suffering from several ailments.
According to the police, they have received complaints from both sides in the matter.
The petitioner requested the court to direct Paschim Vihar police station to register an FIR on the complaint given by him on March 18, 2021 against his daughter. Apart from this, the petitioner also pleaded that necessary directions must be issued to the police to protect him and other members of the household from the respondent daughter till the settlement of the dispute.
Delhi High Court:
A bench of Justice Subramonium Prasad disposed off the petition by directing the investigating officer to provide the mobile number of the beat constable and the SHO of the local police station to the senior citizen petitioner, to ensure that no harm is caused to him or his family. The high court asked the petitioner to approach the competent authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 for remedy.
The court directed the authority to dispose of the case on its own merits, without being affected by any observations of this Court. The court also clarified that whatever remarks were made in this case, were on the basis of their own merit.
