Modi Government To Completely Change Archaic Laws Of IPC & CrPC Which Belong To British Era

The Minister of State for Home has announced that the Government of India will be making changes to several age old laws that have been followed since the British era.

Earlier this month, Kishan Reddy, Minister of State for Home Affairs, said that the Central Government has decided to completely change the Indian Penal Code (IPC) and the Code of Criminal Procedure (CrPC). A conference had been organized on behalf of the Anandi Foundation on the subject of woman safety, wherein, Reddy took the stage and spoke about the archaic laws.

Addressing the seminar, Reddy also stated that the centre has written to the Chief Justices, senior lawyers, police officers, NGOs and state governments with regards to the matter. The Minister of State for Home also requested all to join in the efforts for Gender Justice. He quoted,

All of us should come forward and work towards ensuring that there is no gender injustice.

Reddy also said that they have done a good amount of work in this regards and quoted,

Now we will also change the IPC and CRPC which belong to the British era. We have been amending these two sections from time to time, but looking at the present scenario of the country, the government has decided to completely change the IPC and CrPC and for this.

We have written to the Chief Justice, Senior Advocates, Police Officers, NGOs and to state governments.

Reddy further said,

A committee has also been formed for this. I appeal to all of you to make suggestions on what changes should be made in IPC and CrPC.

Union Law Minister Ravi Shankar Prasad, last year, had already announced that the Narendra Modi government has formally revoked 1,458 old laws. Adding to the same, Reddy said,

This is being done to ensure fewer laws and more governance. Also repealing old laws is a continuous process.

On July 29, the bill was passed by the Lok Sabha. On August 2, the ‘Repelling and Amendment Bill, 2019’ was passed by the Rajya Sabha by a voice vote.  A committee has identified 1824 old laws which are basically null and void in today’s scenario.

Hence, while presenting the bill in the Upper House, Law Minister Ravi Shankar Prasad had quoted that after the BJP-led government came to power, they decided to get rid of those void laws.

Our Take:

• When the government talks about Gender Justice, we truly hope the same will be led in a direction where we don’t favour women with more biased laws
• Men in India today virtually have no laws in their favour, or to put it in a more balanced way, men do not have laws which are fair for their defence

• Government of India must certainly consider the plight of Men and their families before amending and structuring laws which may seem ‘popular on social media’ but may collapse the family system in reality
• Having said so, doing away with redundant laws should hopefully reduce the burden of ‘ego battles’ in court and justice could be faster unlike cases which take a minimum 15-20 years
