Kerala Government To Make Registration Of Divorces Mandatory In State

The Kerala government has decided to enact a law making registration of divorces mandatory in the state. If passed, Kerala will become the first state in the country to make divorce registration compulsory through legislation.

On Thursday, Excise Minister MV Govindan said that required laws and amendments would be introduced, reported India Today.

The Minister said that the procedure is being followed as per the recommendation of the Kerala Legislative Assembly Committee on the Welfare of Women, Children, Transgender and Disabled.

Minister MV Govindan said,

There is no law in any state in India requiring a compulsory divorce registration, Kerala is setting an example for the country on this.

Marriage and divorce are included in the concurrent list of the Constitution, so the state has the power to legislate for divorce registration, the minister added. If the couples have any children at the time of divorce registration, details about their care will also be included. The law will be enacted to ensure the future security of children when couples remarry. The minister said,

A 2008 report by the Law Commission of India stated the need to register marriages and divorces. And it is recommended that it be applied to all citizens across India, irrespective of religion or personal law. However, no legislation has been enacted.

The legislation will be enacted under the Kerala Marriage and Divorce Registration Act. The Kerala Marriage Registration Rules, 2008 will be amended to include provisions for registration of divorces.
