Dear Men, think 1000 times before you get married in India! As a husband, you have almost zero rights, and whatever recourse you have in the law, may not be just or fair.
In a recent case, the Gujarat High Court reunited a married woman with her lover against the wishes of her husband. While adultery is no longer a criminal offence in India, it remains a valid (civil) ground for divorce.
Case:
Due to marital discord, a woman in Gujarat had left her matrimonial home and returned to her parents sometime ago. She also left behind her son with her husband.
Post separation, she met another man and the duo got into a live-in relationship, without the woman being divorced. The couple has been living in the Amreli district’s Khambha town since January this year.
However, when the wife was forcibly taken away by her husband, the woman’s paramour approached Gujarat High Court to seek justice.

A bench of Justices AY Kogje and SJ Dave directed the police to bring the woman before court. The woman appeared in the High Court on April 8, and expressed her desire to accompany her live-in partner. Speaking with TOI, Advocate Rathin Raval, who represented woman’s live-in partner, said:
Since high court was in the habeas corpus jurisdiction, it just followed the wish of the corpus (plea) and allowed her to go with the petitioner.
Raval further added that looking at the history of violence in this case, the live-in couple also requested police protection for themselves, and subsequently, the High Court ordered such protection till they reached the home of the live-in partner.
