India has been perpetually told that domestic violence is synonymous to in-laws beating up daughter-in-law and how only and only the bahu can be the victim of such abuse. However, feminists who champion women’s rights never speak up against atrocities done to elderly women, often the husband’s mother (and father). Read one such story reported from Rajasthan.
Case:
Bhinyaram Chaudhary (62), retired from State Bank of India, and his wife Rampyari (62) are residents of Indira Colony in Nagaur city. The elderly couple has been thrown out of their own home and are seeking justice since past 118-days.
Bhinyaram gave a complaint to the Chief Minister, Collector, SP and SDM, however, there was no one to hear their ordeal. According to him, their house has been forcibly occupied by his elder son Ashok Kumar and his wife Pooja. Both the senior citizen parents are also suffering from serious diseases like kidney ailments, diabetes and BP.
Bhiyanaram’s elder son Ashok Kumar works as a Public Health Manager in the Medical Department. According to the father, no legal action has been taken against him due to his position.
On June 15, Bhiyanaram told both the son and daughter-in-law to shift to plot number 312 out of two houses built on plot number 311 and 312 in Indira Colony. However, the son and daughter-in-law both allegedly got furious, refused to leave and instead threw the parents out of their own home.
Properties and Legal Right
Bhiyanaram said that he has built houses and plots from his own money. According his son and daughter-in-law have no legal right on it. After this incident, the elderly couple tried to convince their daughter-in-law for first 10-days, through the intervention of relatives and other family members, however, she did not listen to them.
After being evicted from the house on June 15, the couple stayed at a rented room for a few days. However, now they have been forced to live in a shed near their daughter’s home.
Police Complaint
The elderly couple had to take recourse to the law. They wanted to register a case against son Ashok and daughter-in-law Pooja in this regard at Kotwali police station, however, the police allegedly did not listen to them. After this, a memorandum was given to the SP and a case was registered at the police station.
The parents demanded that the son and his wife be evicted so that they can go back to their own home, however, the police couldn’t do much in the matter. The police did not even allegedly take any action with regards to assault case filed by the old couple.
Shockingly, the police even allegedly gave advice to the elderly husband and wife to take the help of society, instead of law. Subsequently, a complaint was registered through Rajasthan helpline number 181, but couldn’t find much help from here too.
Matter Reaches Court
Bhinyaram alleged that Ashok Kumar’s brother-in-law Rampratap Chhaba and one of his friends, Mularam Gurjar, are working in the police. Due to this, the police was allegedly biased and did not help them.
Later, the matter went to the SDM court. The elderly couple told the Collector and the SP, that the son and daughter-in-law were constantly threatening them, through relatives and society. Bhinyaram also said that no one was ready to hear their problems, due to which he was on the verge of suicide.
Initially the SDM got transferred and later a new person took charge on August 1. Bhinyaram alleged that new SDM Sunil Pawar first spoke about resolving the matter legally. However, on August 4, when the elderly couple went to meet him, the SDM advised them to settle the matter through society and family.
Now, the case has been dragging by giving date after date. On October 8 hearing, Bhiyanaram alleged that they were made to wait throughout the day, and later another date was given for October 11. They were also advised to move civil court.
In the interim, Ashok Kumar moved civil court himself and appealed for a stay to stop the sale or any other work of the house.
SDM Sunil Pawar told Dainik Bhaskar,
Action can be taken in the matter under the Maintenance Act, but I do not have the power to get the possession of the house as per their demand. I have also directed the SHO for further action in this regard.
In a similar case on August 1, Kanpur Police Commissioner took action against the son and daughter-in-law and sent them jail for 14-days. He also assisted in getting possession for the elderly parents.
