Jaipur Family Court Grants Divorce To 400 Couples During Lockdown; 40% Marriages Between 1-3 Years

The COVID-19 pandemic has surely been a testing time for several married couples and unfortunately many of them have not passed through the same. While a set of families saw the lockdown as an opportunity to live together, many couples, largely the ones in recent marriages, were unable to adjust 24/7 under the same roof with each other.

The below figure have been reported from the Family Court at Jaipur.

Divorce Petitions

With the existing 8150 cases pending in the local courts, 500 additional divorce cases were filed only within a span of six months, between June 2020 to December 2020.

The family court also granted divorce to around 400 pending and new cases, considering that the marriages had no future. Nearly 40% of these divorce cases pertained to those couples, who had been married for only one to three years.

The family court also received divorce petitions from couples who had been married for past ten to twelve years, however, had been living apart from each other for the last five to six years without being legally divorced. Lockdown was possibly an opportunity for many such dead marriages to end legally by filing mutual divorce petitions at court.

At present, there are 8150 cases pending filed under the Hindu Marriage Act at Jaipur city’s Family court. These cases pertain not just to divorce, but also maintenance and custody of the children.

Few Cases:

1. An interfaith couple tied the knot in 2013 and both side parents were not ready for the marriage. Later, when the couple could not pull through the marriage, they filed for divorce by mutual consent. The court granted divorce seeing no future together as a couple.
2. Another duo who got married in 2008, lived together for the next 6-years, until 2014. However, in 2015, the wife moved court for a divorce. The family court granted the couple divorce in 2020 when both agreed to file petition on mutual consent.
3. In another case, the couple who got married in 2012, stayed together only for a year, thereafter, they both started living separately from each other without divorce. In 2015, when the couple jointly approached court for divorce, they were advised to rethink about the same. However, witnessing no positive approach from either side, the family court approved the decree of divorce in the case by mutual consent.

Former Family Court Judge, Harvinder Singh shared with Dainik Bhaskar that the main reason for breakdown in marriages today is because both men and women are more career oriented and lack tolerance. Divorce has increased due to ambitiousness of individuals, and differences between men and women.

According to Dr CP Gupta, the breakdown of joint families is also one of the reasons, because the marital lives are not balanced anymore.

President of the Family Court Bar Association, DS Shekhawat quoted,

While the number of divorce cases are increasing by the year, the facilities at family courts still remain basic. There is no seating arrangement for the women nor their children.
