Survey | Rights Of Children For Separated Parents | Share Your Experiences & Recommendations For Change

Nelson Mandela said,

There can be no keener revelation of a nation’s soul than the way in which it treats its children.

While our children are going through many issues, one of the least studied or researched is the trauma faced by children of separated parents. Divorce rates in India are rapidly rising, comparable to Iran (14%), Brazil (21%) and China (22%), and it is well known that children are the primary victims of divorce.

When separation of parents is accompanied by Parental Alienation, these “children of a lesser God” go through their life with significant psychological handicaps decreasing their life expectancy by up to 20 years! Recognising the special needs of children of separated parents, our government enacted the landmark Family Court Act (1984) creating special infrastructure and granting significant discretionary powers to family courts.

However, the question is whether our family courts are really prepared to take on the enormous responsibility of parens patriae jurisdiction granted to them by our constitution? It is not just the question of infrastructure (number of courts & judges), but more importantly the human angle of sensitivity and scientific temperament while appreciating best interests and welfare of our children along with the judicial tenets of
transparency, predictability and unbiased decision-making.

We, at BambooTree and Child Rights Foundation have been working in this area for the past ~10 years and feel that the time is now ripe for a change. However, we cannot do this without your help, without listening to your experiences, without gathering the information from the ground and without listening to your suggestions / recommendations for change.

So, What Can You Do To Help?

2. Please send this survey form to any friend / acquaintance with children who has been to family courts in India. You are free to post the above-mentioned link in your Twitter / Facebook / Instagram account with hashtag #ChildRightsAfterSeparation and #RightToParent
3. We have a separate survey for advocates and judges… So, if you know any advocate or judge who may be willing to fill it out, please reach out to us (bambootreengo@gmail.com) with the Name (+ E-Mail ID / Mobile number) of the advocate / judge and we will send you or the advocate / judge the link. The survey form for judges / advocates is shorter and will take only 10-15 minutes to complete
4. Our final report will have few detailed case studies and quotes from many parents. So, if you are willing to spend a few hours in writing your story, please write to us at bambootreengo@gmail.com, we will be happy to assist you with pointers and structure for the same, however, the words will be yours. Your and your child’s name will be kept confidential in case you desire.
