As social media warriors discuss criminalisation of sex within marriage (which can be labelled as rape purely on the testimony of the wife), we fail to understand the other side of gross misuse, which is already prevailing in society today. Yes, all laws can be misused, but no other criminal law is based on word of the woman!
A special POCSO court in Coimbatore imposed a fine of Rs 2,000 on a woman for lodging false sexual assault complaint against her husband.
According to the complainant, husband had sexually assaulted her younger sister in 2019. She accused her husband of raping the 16-year-old sister, who was residing with them after the demise of her parents.
The man was arrested basis a complaint registered by the wife. However, now after completion of the trial that took nearly 3-years, the judge has acquitted the accused man and imposed a fine on the woman for filing a false sexual assault complaint.
