Remember the recent IIT-Guwahati (IIT-G) case where there was massive outrage on bail granted to the accused – with headline that read as – “he is future asset”. While, the bail order clearly stated that the same was being granted, because investigation was complete and the accused had already spent time in jail, mainstream media headline, led to endless debates without even understanding the crux of the bail order.
Now, in a recent development in the matter, IIT-Guwahati has terminated the student who was accused of raping a fellow student, stating that the reported act of “gross indiscipline” perpetrated by the accused, violating the students’ code of conduct, “had to be strictly dealt” with by the institute.
The IIT-G Senate was unanimous in their decision to confer exemplary punishment against the accused as the institute will not compromise on the safety of women in the campus.
One must note that the accused boy is out on bail and not yet convicted.
Case:
On April 3, the police had arrested a 21-year-old IIT-G student for allegedly “sexually assaulting” a contemporary female student of the institute on March 28. Subsequently, the accused was suspended by the authorities.
Citing that he was a talented student and a future asset to the state, the Gauhati high court had previously granted bail to the accused and had stated that there was no possibility of him tampering with the evidence. At the same time the court had held that there was a prime facie case against the accused.
A special meeting of the Senate was held where it was decided that the final recommendation of the students’ disciplinary committee (SDC) meeting, held on September 3, for termination of the accused student from the institute will be approved with immediate effect. The minutes of the meeting read,
The Senate upheld the recommendation of the SDC to terminate the rape accused student from the institute with immediate effect.
The Dean of Students Affairs (DOSA) informed the Senate that the student has been granted bail by the Gauhati high court on August 13. The court in the order stated that there was a clear prima facie case against the accused petitioner and the investigation of the case was completed.
IIT-Guwahati expelled the accused observing that it was “necessary to confer exemplary punishment on the offender”.
The DOSA updated the Senate about the final recommendation of the students’ disciplinary committee (SDC) meeting, held on September 3, to terminate the student from the institute with immediate effect.
When contacted, an IIT-Guwahati spokesperson told The Indian Express,
The student from IIT-G has been expelled….the institute cannot comment further the as matter is subjudice.
MDO does not believe in supporting a convicted criminal. We also refrain from taking sides in the matter. We are only raising a question, whether institutions must expel students before conviction in any case.
