After the above ANI story was republished by several publications and portals, Pradeep & Meenu Agarwal’s legal team has sent us their side of the story:
The FIR 11.02.2021 has been filed by one Mr. Surendra Musely, against the Directors of MADS Creation Private Limited alleging that our clients have supplied the materials which is not equivalent to the money that has been transferred to the account of MADS Creation Private Limited. In the FIR, it has been further alleged that MADS Creation Private Limited has not completed the execution of work as per the scheduled time frame. It has been further alleged in the FIR that Mr. Alam (Project Manager/Accountant) of MADS Creation Private Limited is demanding a further sum of Rs. 15,00,000/- (Fifteen Lakhs only) to send the technicians which has shocked the General Manager of M/s. Shreya Broadcasting Private Limited. Based on these allegations the FIR was filed with Police Station Jubilee Hills.
That our clients, M/s. MADS Creation Private Limited and its Directors and Project Manager, had joined the investigation and filed a detailed reply giving the details of the contractual agreement which were entered into between the parties including the schedule of the timeframe along with the timelines for the release of the monies as per the terms and conditions as agreed between the parties.
That our clients M/s. MADS Creation Private Limited and its Directors and Project Manager, had received a Notice under Section 41a of the Code of Criminal Procedure for being present on 27 March 2021. Even though the Call was received at the last minute, our clients made suitable arrangements to be present in Hyderabad on 27 March 2021. On reaching the Police Station at 12:15 pm, our clients were told that Investigating Officer is on leave. Our clients were made to wait endlessly, and repeated messages were sent to the Investigating Officer, as our clients were scheduled for a return flight to Delhi by 8:15 flight pm. After repeated pleas, the Investigating Officer asked our clients to meet the SHO at the Police Station.
That our clients were surprised to see that the SHO prior to meeting our clients, called the complainant Mr. Surendra Musely, a Journalist from Tv5, and some other persons at about 3.30 pm to the Police Station. Thereafter, also the SHO kept our clients waiting whereas the SHO hosted a tea party for the complainant and Tv5 journalist who accompanied him. The complainant and Tv5 journalist were well known to the SHO as they met the SHO by touching his feet and seeking his blessings. After a long wait, our clients were called in wherein the complainant and Tv5 journalist were present in the room. Not even one question relating to the investigation was asked by the SHO in this discussion. In fact, the SHO along with the complainant and Tv5 journalist tried to force a settlement on our clients which was not the scope of the investigation and was rejected by our clients. Thus, even in the earlier occasion, i.e. 27 March 2021, the complainant has tried to exert pressure on our clients through media to settle the matter on their own terms and conditions. 6. That our client states that the factual narration of the First Information Report coupled with undue pressure exerted on our clients is only an attempt to bulldoze our clients to enter into a settlement which is not acceptable to our clients.
That our client states that on 14 June 2021, for the first time a Notice under Section 41a of the Code of Criminal Procedure was served upon our client, namely Mr. Pradeep Agarwal asking him to appear before the Jubilee Hills Police Station within next 7 days without supplying the additional statement made to the Police on behalf of some employee of M/s. Shreya Broadcasting Private Limited. Based on this notice issued by the Police.
