41-Year-Old Businessman Acquitted From False POCSO Case After Spending Three Years In Jail

False cases of sexual harassment, especially involving minors as alleged victims, have been on the rise. While the same may sound unbelievable, many women are using their minor daughters/sisters as tools to settle score with either husbands or their family members.

One such case reported from Mumbai is nothing less than petrifying, assuming the same can happen to any male member of your family.

Case:

A special POCSO court in Mumbai acquitted a 41-year-old businessman on Saturday, who spent three years in jail for allegedly sexually assaulting his former daughter-in-law’s 17-year-old sister.

The court held that marital disputes between the alleged victim’s sister and the accused man’s son was the reason for lodging the complaint. The complainant had made the allegations as an adult in 2018, claiming that the alleged sexual assault took place between 2016 and 2017 when she was a minor and was employed by the accused at his factory.

The court observed,

Adult complainant has made belated allegations, which are not supported by any independent witness or by her own mother. There is reason for the complainant to falsely implicate the accused.

It further said that the accused (father-in-law) was initially opposed to her sister’s marriage with the businessman’s son.

While the complainant’s sister did not depose, her mother was a prosecution witness. However, she did not say anything about the alleged assault. The court noted,

The mother did not depose that her daughter was raped by the accused. On the contrary she deposed that she did not know what happened with her daughter when she was working in the factory. In the cross-examination, the mother deposed that she contacted the accused on phone and they talked in good terms with each other.

The court also pointed out that no mother would remain silent if her minor daughter was repeatedly subjected to sexual assault by her other daughter’s father-in-law.

• In all such cases, one only questions why are there no implications on the women who file such false cases?
• How will the court compensate – financially and socially – for the three years lost in the life of the man?
• Is it time, names of all false accuser women be made public as they are no more ‘victims’ of the crime?
