The Yogi government is planning to take a big step in order to secure the welfare of senior citizens in the state. The UP state government has announced that the children who do not support, take care of their elderly parents or provide them with a dignified life, will be asked to leave from their homes.
The UP government will be soon bringing in a law which will deal with sons and daughters who transfer properties on their names and then desert their old parents.
The Yogi government stated that this law will protect old parents and ensure they are not left to wander in the streets by their children. The government is preparing an amendment by including the process of eviction in the Uttar Pradesh’s elder parents or senior citizens maintenance and welfare rules – 2014.

The State Law Commission for the largest state in India, has prepared a draft of the amendment for the government and sent its report only recently.
Over the years, many courts have witnessed cases of elderly parents and their children fighting with each other over property matters, and in many cases, the old parents have been thrown out of their own homes. There have also been many judgements from time to time to demonstrate how many children are not taking care of the senior citizens at home and the stories of domestic violence against them have been appalling.
The government is expected to decide on these recommendations soon.
Our Take:
- While covering several stories of Domestic Violence on Senior Citizens in India, it is often the case where daughter-in-laws have been instrumental in instigating the husbands to ill treat their parents
- There have also been cases, where old people are threatened with false cases against their son and themselves, due to which they succumb and transfer their assets either in the name of son or daughter-in-law
- As much as we cannot generalise these situations, we rarely see cases of domestic violence against senior citizens by an unmarried son

- Domestic violence on anyone by any gender must be condemned strongly, however, Uttar Pradesh government must also ensure that justice is served and guilty are not let free merely if they happen to be a daughter-in-law

A Case where wife demanded that her mother-in-law transferred the matrimonial shared property fully in her name. When the in-laws refused, she filed several false cases against husband and his parents and also thrashed the elderly in-laws at their home.
