The Telangana High Court on Tuesday denied bail to a woman who has been accused of allowing her live-in partner to commit sexual assault on her own minor daughter, reported Livelaw.
The Bench of Justice G. Sri Devi was hearing the plea of a woman seeking her release on bail in connection with a case registered for the offences punishable under Sections:
- 376(2)(f)(n)
- 376(3)
- 342
- 50
…of the Indian Penal Code.
Case:
The woman had developed illegal intimacy with A-1 after the death of her husband. The two were living-in together, when the mother of the child allowed A-1 to commit sexual assault on her own minor daughter. As a result of this, her minor daughter, due to the continuous assault upon her by A-1, became pregnant and also gave birth to a male child.
Further, after giving birth also, the minor victim became pregnant twice and she was administered pills for abortion. The Court also noted that the DNA test revealed that A-1 is the biological father of the male child born to the victim girl.

The high court perused the case record and other material papers and noted that grave allegations were levelled against the petitioner/woman. The court noted that a charge sheet had also been filed in this case.
Thus, the high court remarked:
Looking into the nature of allegations levelled against the petitioner, which are grave and heinous in nature, I am not inclined to release the petitioner on bail and the prayer for bail is rejected.
Accordingly, the Criminal Petition was dismissed and the trial Court was directed to commence and conclude the trial, as expeditiously as possible, preferably within a period of six (6) months from today without giving any unnecessary adjournments to either of the parties.

- Strictest action must follow on both mother and her live-in partner
- The minor girl must be given proper counselling and shifted to a safer shelter with immediate effect
- In most child custody cases, mothers are looked upon as next to God and given complete custody by default
- In this particular case, the biological father is no more, however, in cases where the fathers are very much alive, shared parenting becomes very critical so that both parents are in the know-how for the well-being for their child
