In a shocking case reported from Pune, a techie filed a case against his wife and her paramour with the Warje Police station, alleging that the duo plotted to turn him impotent so that the wife could then divorce him.
Under Hindu Marriage Act, 1955 impotency would render marriage null and void under Section 12(1)(a). The marriage is also null and void under Special Marriage Act as well as Parsi and Muslim Marriage Acts.
Case:
27-year-old Chetan Subhash Surale got married to 25-year-old Smital Surale from Pune in March 2020. The husband is a software engineer, while the wife is a mechanical engineer.
The wife was in a relationship with one Kostubh Anil Gogate (22), prior to marriage, however, she could not marry him due to caste differences. The duo, however, continued their affair after the woman’s marriage.
Amidst lockdown since March this year, Chetan and Smital could not go for their honeymoon, although they visited Mahabaleshwar on October 18, after which the husband unraveled all details. When Chetan learnt about the ill motives of his wife and her lover, he immediately informed his family and then approached the police.
Plot To Turn Husband Impotent
Smital and Kostubh wanted to live with each other, and thus the wife had to first divorce her newly married husband. To ensure a smooth separation, the couple hatched a conspiracy to turn Chetan impotent and then use the same as a ground for divorce.
When husband and wife checked into a hotel at Mahabaleshwar a few days ago, Gogate also went to the same hotel and befriended Chetan. The complainant was still unaware of his wife being in a relationship with the guy he had just got acquainted with. The three of them even partied at the hotel.

While have a drink together, Kostubh told Chetan that he also lived in Warje. However, he had just lost his job due to lockdown. He also mentioned that he was unable afford the rent anymore, and thus requested Chetan if he could stay with them for some days.
After returning from the trip, Gogate moved into the couple’s house as the husband had already agreed to the same.
Soon, husband realised what was being planned behind his back. Chetan asked the accused man to let him go through the photos he had taken during the trip, which were on his smartphone. In the interim, husband figured out the password of the phone. As he was scrolling through, he came across a photograph of his wife’s room, which he identified by the idols of Radha and Krishna that he had gifted her.
Husband became suspicious, and hence, waited for Gogate to fall asleep at night. He then took his phone and checked the same again. He was shocked to learn that his wife was having an affair with the man and they were planning to make him impotent by cutting a nerve off his private part.

Chetan left for his hometown at Ahmednagar the very next day. He shared all details with his parents and subsequently they lodged a police complaint.
Police Statement
Speaking with Pune Mirror, Senior police inspector Machhindra Pandit with Warje Malwadi police station said,
The accused were having an affair prior to the marriage, but due to caste issues, they did not get married. A few days after the marriage, the affair resumed and both of them conspired to make the complainant impotent. A notice has been given to both the accused.
A case has been registered under section 120 (B) (criminal conspiracy) and 116 (abetment of punishable offence) of the Indian Penal Code (IPC) has been registered.
Meanwhile, Smital’s in-laws and her own family have disowned the woman and thus the police have also counselling the accused. On other hand, Gogate alleged that it was Smital who conspired the entire plot and he too has ditched her.
Since the woman is having salary issues amidst lockdown, she claimed to be depressed and suicidal. The cops are now arranging a place for her to stay at INA hostel as she does not have anywhere else to go.
