A married woman from Madhya Pradesh got involved in an extra-marital affair. She divorced her husband, however, when the paramour refused to marry her, she filed a case of rape against him. The Madhya Pradesh high court has now granted temporary two-month bail to the lover for marrying this woman.
Case:
A woman who accused her lover of repeatedly raping her, got him arrested on charges of rape, after he went back on his promise to marry her. The woman was married while she repeatedly got involved in a physical relationship with other man.
Now, in a twist to the tale, the man has been granted bail after the two agreed to tie the knot with his accuser.
Madhya Pradesh High Court
In its order on Wednesday, a single bench of Justice SK Awasthi said the accused was arrested on February 12 for allegedly repeatedly raping the woman, criminal intimidation and under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act from Dewas district. The order noted:
The counsel for the appellant has said the prosecutrix (woman) in her statement which was recorded under section 164 of CrPC had said she was having a love affair with the appellant and he made physical relation with her first on February 15, 2017. Thereafter, he started coming to her house regularly and continued to have physical relationship with her. On the insistence of the appellant she divorced her husband and thereafter he refused to marry her.

The order added the counsel has submitted now the family members of both the parties are ready to solemnise their marriage and in this regard the woman has also given an affidavit before the court. It concluded:
The appellant and the prosecutrix are major and they are ready to solemnise marriage. In the circumstances, the present appeal is allowed in part and the appellant is granted a temporary bail for a period of two months from the date of his release so that during this period he can solemnise the marriage with the prosecutrix.
Time and again we have raised concern over ‘rape on pretext of marriage’ cases. A man can back out of marriage for several reasons, one of which can be compatibility or cruelty by partner before marriage. However, blackmailing him with charges of rape and almost compelling him to marry the woman is highly unfair and inhuman.
Do we ever have women getting arrested who back out from marriage after dating men for several years? These kind of Gender Biased Laws may not help much in the future of such marriages either, and women may be encouraged to repeatedly keep filing false cases on men, to keep them under their control.
