The Gujarat High Court on Wednesday quashed an FIR against a woman who tried to kill her two children and later end her own life. The woman was booked for attempt to murder. While all three later survived, here’s what actually happened.
Case:
33-year-old Lata Lathiya is married to Jitesh Lathiya, who is a diamond broker by profession. Husband had been living separately from his wife and two children — 13-year-old daughter and 7-year-old son — since past eighteen months due to marital discord. Jitesh works in Mumbai, but was living at his native in Bhavnagar during lockdown.
In the beginning of June, Lata gave milk laced with rat poison to both her children and also attempted to kill herself. However, later the woman made a video call to one of her relatives, who arrived immediately and shifted all of them to a hospital. All three survived and the husband subsequently lodged an FIR against his estranged wife at Amroili police station in Surat on charges of attempt to murder of his children.
Although, Lata and Jitesh reached and amicable settlement, and the woman approached high court to get the FIR quashed. The husband gave his consent and did not object to the same. The high court was informed that the woman took this extreme step ‘out of frustration’.
High Court Observation
Justice A P Thaker noted that there had been a settlement between the couple and thus he quashed the FIR against Lata. He also said that since the family dispute had been settled, there was no chance of getting the woman convicted.
The court added that the woman was frustrated since she had no income of her own and the man was not paying her maintenance.
Since the court decided to drop all charges against the woman, the state government suggested that the woman can be employed with Mahila Gruh Udyog in Surat for a livelihood and mend her financial condition. The court issued necessary instructions, however, left the decision of joining the NGO to the woman.
