A senior civil judge and additional chief judicial magistrate posted in Vadodara in July 2018, filed a complaint against his in-laws, wife and her two paramours.
On July 2, 2018, Justice Ashutosh Raj Pathak had filed a complaint against his wife Himani Pathak for adultery, while her two alleged paramours were booked for enticing a married woman with criminal intent.
Background
In June 2017, Pathak’s wife had filed a complaint against him with Mahila police station alleging domestic violence and demanding dowry. Nearly after a year, the husband judge accused his wife of adultery.
The husband said the matter pertained to when they came to Bharuch, where he was posted as a civil judge in Bharuch. This is when his wife, Himani Pathak, got in touch with a stenographer of the Bharuch court. The accused paramour was identified as Shrijit Pillai, who used to visit the houses of judicial officers to take dictation.

According to Justice Pathak, this is when his wife got to know Pillai and both shared their contact details. After exchanging the numbers, they allegedly started chatting through messages and calls, said the judge. He also informed police that his former wife and Pillai used to talk over the phone for hours.
The judge learned about his wife’s alleged affair when he overheard their conversation on a phone call in February 2015. The judge informed police, that when confronted, the wife admitted her unlawful conversations over social media and calls with Pillai. The judge also told police that his wife had admitted to having a physical relationship with her paramour as well.
When the judge later informed his in-laws about the same, his wife requested him to forgive her and also gave an undertaking on a stamp paper for not repeating her mistake. The judge accepted her apology then, however, later the wife continued her relationship with Pillai as well as her school friend Priyank Malkan, who has also been accused.

In September 2015, the couple decided to file for a divorce but the family intervened and the couple stepped back from their decision. However, in March 2017, the judge finally filed for divorce at the family court in Godhara when his wife still continued her illicit relationships. The judge later complained against his wife, in-laws, as well as wife’s paramours Pillai and Malkan in July 2018.
The judge also alleged that his wife complained at Mahila police station, after he filed divorce, to save herself. H B Vora, police inspector, Sayajigunji police station then said,
We registered the case on Saturday after getting the complaint. A police sub-inspector is probing the case and further action will be taken as investigation proceeds.
Charges By Wife In June 2017
The wife had filed charges of domestic violence and dowry harassment on her judge husband and his family, after ten years of marriage. Wife complained that her torture had begun one week after their marriage in July 2007.
Himani also alleged that she would be thrashed for going to her parents’ home without informing in-laws and despite bringing valuables and ornaments, her in-laws kept harassing her for more dowry.
