Thane sessions court in Maharashtra has granted bail to a local builder who had been arrested for allegedly spiking a woman’s drink, raping her and recording a video on his phone.
Case:
On May 2, the complainant visited one Jafar Ahmed Shaikh’s Thane office to enquire about a shop when the alleged incident took place. The victim accused him of threatening to harm her and her child as well if she told anyone about the incident. She alleged that he tried to rape her again on May 16 and subsequently, she lodged a complaint on May 19 when he was arrested.
Sunil Pandey, Shaikh’s lawyer argued that she reported the incident after 17 days and alleged that she and her friend had framed the builder to extort money out of him. Opposing the bail plea, the police said there is enough material to show that Shaikh had committed the crime.

Additional session judge P M Gupta ordered the release of Jafar Ahmed Shaikh on bail after furnishing of personal bond of Rs 50,000 and imposed other conditions.
The court said that the woman had paid 10% of the cost by cheque even though her bank account was inactive since March. She also wore the same dress on her second visit, though in the FIR said it was torn when she was allegedly raped on May 2. While the FIR said she was divorced, in her chats with the builder she said that her husband had died due to cancer.
Adding that the charge sheet has been filed and there is less chance that the accused may abscond if released on bail. The court also added,
On the occurrence of such a serious incident, the natural conduct of a woman will be to cut all relations with the accused, instead she was in contact with him.
