The Madhya Pradesh High Court in its order dated February 23, 2022 directed a man – who has been ‘accused’ of beating his wife – to live with his wife at his in-laws’ place for one month “so that the family gets reunited for all times to come“.
The Court has listed the matter for further hearing on March 22, 2020.
Case:
The wife alleged that her husband, under intoxication, had not only ill-treated and subjected her to cruelty and physical assaults, but had also ousted her from home and had forcibly taken the child in his possession.
Therefore, it was her contention that she being the mother, in the obtaining facts and circumstances of the case, was entitled to the custody of the baby, regard being had to the age and welfare of the child.
On the other hand, the counsel appearing for the husband denied the allegations stating that the wife had left the matrimonial house on her own, leaving the child with him.

The bench of Justice Rohit Arya was hearing this habeas corpus plea filed by the wife seeking a writ of habeas corpus for production of the missing corpus of her baby boy of two years of age.
During the course of the hearing, the husband stated that the wife was welcome to come back home and live with the family and that he shall take all due care, however, the wife expressed the apprehension of recurrence of her husband’s misbehaviour and ill-treatment.
Under these circumstances, the Court made a suggestion that the husband should go and live in the home of his in-laws (wife’s maternal home) for a period of one month.
This suggestion was welcomed by the parents of thewife present in the Court and that also stated that they are not only prepared to allow husband to stay with them but would also take good care of him so that the family gets re-united for all times to come.
Appreciating the gesture shown by the parents of the wife, the Court directed thus:
- Husband, with the baby boy, will go with the parents of the wife to their house and shall stay there for a period of one month
- Parents of the wife and the husband shall ensure good care of him This, in fact, is a healing process for the healthy and united life of the couple with their baby
The court has ordered the wife, husband and wife’s parents and corpus to remain present before the Court during the next date in March.
