Special fast track court in Delhi has acquitted two men accused of gang raping a woman. The complainant alleged that she was gang-raped inside a factory two years ago in January in 2019.
Since the court found the charges to be false, it has now ordered an FIR against the woman.
Case:
A 26-year-old married woman, who lives with her family in Delhi, had given a written complaint with the local police station stating that she was taken to a factory and gang-raped in January 2019. According to her statement, she was asked to come to a factory of Sherwani in Bihari Colony for work, where she was later raped by two men named Ismail and Shakeel.
The woman alleged that she was hired for cutting thread job at Rs 8,000 per month salary. However, after completing her work, when she was returning home, Ismail allegedly called her and asked her to come back to the factory again. He then directed her to be present in a room which was inside the same factory.
The woman said that Ismail made her unconscious after giving her cold drink laced with sedatives, post which she was raped by both the accused men. The woman later also alleged that both the accused also called their third partner to join them. However, seeing her condition, he backed out.
Filed Rape Complaint
The victim went straight to her house from the alleged crime scene and the next day, filed a written complaint with the police station. She was sent to Hedgewar Hospital for her medical. After recording her statement in front of the magistrate, the cops registered a case under relevant sections, including gang-rape, and arrested the two alleged accused.
Kadkadduma Court (Delhi)
The Special Fast track court, after hearing all the facts, evidences and statements of witnesses related to the gang rape, said that the charges including the gangrape on both the accused could not be proven.
Hence, both of the accused have been acquitted giving them benefit of the doubt.
FIR Ordered Against Woman For False Rape Complaint
The court has ordered registration of an FIR against the woman who filed the false rape case. It has also directed the government to take back any compensation amount from the woman – if she had been awarded as per earlier circumstances.
